    • I took out an unsecured personal loan with Mint (Royal Bank of Scotland) in 2006. Later that year I moved overseas. I own and rented out my property in the UK. During the financial crisis I hit hard times and defaulted on the loan. I had updated RBS with my contact details overseas but it has transpired that they obtained a CCJ and then placing a lean on my property with the Land Registry. I did not know about this until recently. Some initial investigation tells me that RBS or their solicitors sent/served all court documents or demand letters to the property in the UK where they knew I did not reside. I've just looked into shifting my mortgage and can't do that with this entry. It's for about five thousand pounds.   I want to query if anyone knows whether I can get the registry entry removed on the basis that I was not served and how I'd go about that? I have none of the documents from Mint but I know I'm past the statute of limitations now and I'm wary of getting in touch with a request for any and all information about this in case they deem it an acknowledgement that I owe the debt? I would expect they would have some record of my communication as to my change of address. I also had a credit card address with them at the time and have some old documents posted to my overseas address that can verify I did communicate with the company as to my overseas status and address. I think with the CCJ on the loan they were up to skullduggery so I would not defend it.   Past having the land registry entry removed, I wondered about getting the debt vacated. When I was struggling with the debt around 2009 I sought advice on here on what could be done and I seem to recall an issue with banks having invalid contracts around 2006-2009. In short, the contracts were void and I think the advice was that they couldn't enforce. I can't recall if that was correct and I wondered if anyone on here knows what that was about?    I'm also wondering if I should just make a complaint to the financial ombudsman and see if they can resolve the issue? I had a complaint in against my Mint card with them in about 2011 regarding a declined chargeback request which got resolved quite quickly, I got the view that the complaint and the amount (also about five grand) wasn't worth their time and so they offered a refund on the amount.   Many thanks for your advice!

    • Hi   Just thought I would pop in and see how this is going?   If other residents are having the same issues the all need to make a Formal Complaint to the Housing Association and title it as such each individually and they all must point out this is a Health & Safety matter with tiles coming off the roofs.

Unfortunately, I believe that Vampiress has moved on out there into the 'Big Bad World'...:o

 

Personally, I've always recommended using a very user friendly spreadsheet originally done by Mindzai (v1.9)

Mindzai's Contractual Interest Spreadsheet

 

It's advantages are that it can also calculate S69 Interest for the same set of inputted data.

Hi I put a claim in over a year ago and it has a stay put on it but my claim relied on the principles of mutuality and reciprocity which is now dead in the water and I'm lead to believe and Sempra is the way forward. My claim is still on hold so what should I do can I change anything or will I still have to keep with claiming CI on the basis of mutuality and reciprocity?

Hi guys I'm just getting round to doing my claim, which hopefully I can get heard thanks to hardship criteria. I'd love to claim interest at the contractual rate if at all possible - I have charges going back ten years! What is the current state of play with it?

 

I see someone lost a case in the high court about it, how come the banks were able to challenge that without conceding the unlawfulness of the charges - was there two cases involved?

 

Any advice/help/references appreciated

Couldn't find where I should really post this, so am trying here as you seem as if you can all do maths! - apols if I'm interrupting the thread, just need a quick answer.

 

Am filling in a Request for Judgment against Nationwide, and have got Warrant of Execution form, intending to give both in tomorrow.

 

I claimed the "interest pusuant to s.69 County Courts Act" at 0.00022 per day, but didn't really understand it. Now it looks like I have to calculate it and put it on the Request for Judgment where it says "Interest since date of claim (if any)"

 

Tried to calculate it online (from date of issue until tomorrow when I'll put in Request the number of days is 774); the answer I got was: 0.17028. I have a severe mathematical learning problem, don't understand figures at all, and this doesn't mean anything to me! Can anyone tell me what it is in money? Surely it can't be 0.17 pence! Or is it pounds? It doesn't seem very much for over 2 years! Should it be compound interest? If so, does anyone know what the total is?

 

If any of you can help with a quick calculation, It'd be much appreciated.

You have missed a step:

The correct formula is: 0.00022 x Number of days x Value of claim = Interest

 

So what you have done is 0.00022 x Number of days (774) = 0.17028

 

Now what you need to do is 0.17028 x Size of Claim.

 

For example if your claim is for £500.00 it would be 0.17028 x £500.00 = £85.15.

 

By the way I do not think you can apply for a warrant of execution until you have a judgment.

WOW and WHEEEEEEW I have finally read through the thread in its entity and my eyes are now bleeding, it took me a fews days though.

 

I am now off to read the others links provided for for more up to date arguments based on restitution.
