    • If it was done via N245 and the payments are up todate then the landlord must make an application with fee for a redetermination. Can't execute with bailiffs can't do anything until he attends a hearing and presents his arguments    ignore. Andy
    • Sorry I didn’t think to come and update this.    So the outcome was that he went to court. Apparently the judge told the landlord off for not sending a letter before action but did nothing about it. He didn’t accept all the damages the landlord claimed, and told him off for accusing my friend of deliberately and maliciously damaging anything, and he awarded him small amounts of the damages he claimed for. The landlord had also made an awful lot of things up that never existed and accused my friend of stealing them, and the judge didn’t accept any of those claims.   However, I’m back asking advice now. So he made an offer of payment via the court forms, sometime before Christmas and straight after the hearing. The landlord didn’t reply so the court accepted the payments.  My friend has been paying the £10 a month each month. Then a couple of days ago he had received a letter from court with a hearing date in a couple of weeks, and a very irate letter from the landlord saying that my friend has consistently lied and that nothing he says should be believed, and that he wants the bailiffs to be called on him and that he absolutely refuses the payment plan. The letter is marked as received by the courts in December and this is the first that’s been sent since then. My friend and his wife are now panicked, what does this mean? And can they now get bailiffs sent round? He earns an ok wage, which somehow the landlord has referred to in his letter, but he equally has a lot of expenditure and can’t afford to pay any more. What will happen at this hearing and can they send out the bailiffs just because the landlord wants them to?    I have no clue what to advise him, can you help at all please?
    • Thanks Bank – I took your cynicism / experience on board and responded thus: Thank you for your response Mr Schnur  I set out my position quite clearly in my letter of claim and nothing has changed. Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute. I would also refer you to the outcomes in PENCHEV v P2G (225MC852) and SMIRNOVS v P2G (27MC729).  My deadline for action - 1 May 2024 - still stands.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes we are! It's not easy-even when you're in the right-because most of us have an innate sense of fair play and decency which makes you think that people wouldn't 'treat you like that' if you were an ok sort of person.

That must be the biggest wrong perpetrated by institutions such as the banking industry.

I'm not an extreme sort of person but theres a quote springs to mind along the lines of 'for evil to flourish good men should do nothing'.

Don't lose heart, you have a lot of support here-from good men enabling others to do the right thing.

In the process of moving my mortgage, reported RBS to the financial ombudsman and awaiting their reply, but really feel like a SOS bottle floating in a bloody big sea right now. Still fighting, but feel a bit like a knight that says neeeeee

It sometimes comes to that Ted-hanging on from minute to minute, but at least you're hanging on-and managing to keep your sense of humour! We're all with you, and at least you now have the tools and the practical help from this site that means you're in with more than a fighting chance of winning. Hang on in there!

I think what the b**turds are doing is digusting!I'd point out to the bank that you wouldn't be in arrears with your mortgage if not for their charges, and it sounds like they were in control of YOUR mortgage and didn't tell you it was behind from what you've said(send to CEO, addy on this site)get on to BIG newspaper (news of the world would be good)GET free advice from the citizens advise bureau (we have and it's a relief, they were very helpful)and your in depute with them so i don't think they can do anything to your accounts.Don't forget that they have to make every effort to retreave any arrears BEFORE they threaten you with legal action(just like WE have to to get our money back from THEM)or they forclose on your mortgage they don't seem to of done this. google Bob Egerton or visit his site @ bankchargeshell.co.uk/forum he seems to know more on this subject than anyone!

Afternoon all,

 

Quick update. Accounts all handed to their credit collection service who basically told me the account closure 2 days after a refund was pure coincidence. A week later I have a phone call from them telling me they have received my complaint from the financial ombudsman and "would like to discuss the situation". So far they have offered me half of my claim. I refused and told them I will be in contact in due course with what I feel will be an appropriate course of action.

 

I think the banks are becoming even more scared of large claims when people no longer have anything to lose. We will happily take them to court for the full amount and they seem to never want it to reach that stage as we all know what will happen. I am going to push the envelope as far as I can on this one.

Bloomin' heck, if time flies when you're having fun then considering how quick it goes when your life is flipped upside down? Business has gone balls up and mortgage is currently being switched but I am more determined than ever to make the f***ers pay. I had a buyer for my business who spotted my weakness and sat and waited until I went under so as to pick up the lease and business on the cheap. shafted ig time

 

In all honesty it is a relief to be out of the business but if the bank now think that is it then they can think again. All it means is that I have more time to rebuild my life that I was previously wasting on saving my business. Charges have continued to pile up and i think I will now be pulling in all the relevant info as my recent statements have gone to my old business address that i am locked out of.

 

Bank charges, business collapse, life in tatters.............nah. Consider this a resurrection. This is time for a Lazarus event.

 

Any advice welcome but consider that money is very, very low. I want this. I want this bad!

Welcome back Ted - real sorry to hear about the business, I had one go once during the recession after 10 yrs building it. As you say it's bl...dy awful fighting to keep it but after a while you realise there's a life out there! You are one step further now to taking control back of your life - it can only get better. I'll check through your thread again and come back later. Anyway, since you were last here there's about 20,000 more people behind you now :D Good luck my friend.

good luck Ted, similar-ish situ here, self-employed and unable to work properly due to long term back problems. At least you're in the right frame of mind to deal with it.

I only mouth my opinion, please look elsewhere for sensible advice! :)

Actually stuck on filing the claim at the minute, Got to the point of receiving an offer from RBS for half of the claim (surprise) when things went pear shaped and it it had to go on the back burner. Now I assume any post from them has gone to my work address so I need to climb back on the horse and go at it again. As I have given them my final letter can I simply hit them with the claim even though there has been a break in proceedings?
