I see also (zooming in closer) you have APR etc there although it's written in by hand and also states 'anticipated' monthly payments.

 

Under 'F' in related particulars it states "see condition four overleaf". So there are other parts to this agreement? I take it you don't have those?

Since the form refers to information 'overleaf', I would ask that you be supplied those 'other parts' to the document.

 

Section 78(1) of the Consumer Credit Act 1974:

hi davey77 and all,

 

i've just read the terms and conditions, and the "overleaf" referece that you referred to, and it would seem that the T&C in the original were on the back of the agreement, as in several of the terms and conditions, it refers to "as laid out on the front of this document", so no, there are no other parts to the CCA.

 

how do i now proceed??

Doesn't sound like a complete agreement then. I would write asking exactly for that.. all parts of the alleged agreement and any other document referred to in it.

there are no more parts to the agreement. one photocopy is of the front of the document, and one photocopy is of the back of the agreement. there was only ever, according to this, one sheet of paper. CCA on the front and T&C on the reverse. these are as per photocopy.

 

now what do it do???

Having gone through the thread from start to finish again (and seen i haven't been very on the ball) it's hard to say where to go with this one.

 

Their condition 4 overleaf i mentioned before seems to match up with the 'back' of the document. (Was hoping there would be a discrepancy there.)

 

All i can suggest is looking closer at the PPI angle and also at grumlins point (post 36) about being overcharged interest?

You could certainly view the £20-£30 charges you've been penalised with as unlawful.

 

I would make an appointment with a CAB that has a specialist debt advisory service and point out these areas and ask them to go through the paperwork.
