hi everyone not sure if i am doing this right i am not computer savvy anyway my son checked his credit file with experian and he has a ccj with orange and money outstanding of 397 pounds this was 2004 he vaguely remembers and thought he did a settlement but it was over the phone so no confirmation in writing (oh if only i knew about this site) so he queried experian and after experian sending off to orange was given number to phone orange will he did today and yes they want thier money of course no record of any settlement and they will take him to court if they dont get it anyway we searched threw drawers anf found a direct legal collections book so we thought he paid them but apparently not and they wanted 170 legal fees he has not heard anything since 2004 any advice please the court was northampton

Hi candlerose and welcome to the CAG.

 

A default will stay on a credit file for 6 years unfortunately. What I did though was explained to Experian that the I was disputing the default. What they do is put a Notice Of Correction on that part of your file. This explains to any potential lender that they should not take the default "as read" as it is in dispute.

 

If your son had no contact with anyone regarding the debt for 6 years, then the debt would be "Statute Barred" and they could not pursue your son in court for the debt.

 

 

If all else fails, kick them where it hurts and SOD'EM;)

I'm not sure whether the call to Orange constitutes "acknowledging the debt". If it does, then I presume it will be another 6 years from now before they cannot pursue it further. The default will automatically be removed in another 2 years anyway but he can get Experian to put a Notice Of Correction on the file anyway.

 

I would let it lie now unless they start sending letters again. If they do, then just put a post here and I will get a message to tell me to look at it.

in your first post you said that your son has a CCJ is this correct? If so have you got any more information on this?

 

If he did the settlement over the phone and paid it at the same time would he have bank statements he could check to see if Orange took the money?
