    • ive already CAREFULLY explained how it all works earlier. what you will have to pay is already preset and detailed on the court forms/TfL stuff you already have. you wont be asked any questions upon your financial means etc. thats not under debate . you wont be asked upon any mitigating circumstances, you have pleaded guity which you always SHOULD.  the ONLY 2 reasons you are attending is to: 1) after finding the TfL prosecutor... plead directly face to face before you go in to try and get an OOC (you can bring up or say anything/everything you like ...anything that might get them to agree) 2) if 1 fails...show your genuine remorse face to face to the magistrate, BRIEFLY mention how a criminal record would hinder your future then hope they take pity on you and dont also record this on your file.  PS its only declarable/shows there for one year anyway. regardless to what an employer might ask in job questionnaires past 1yrs you forget about it. they cannot see it even on enhanced DBS etc etc. you should not latterly ever appeal a criminal record for this type (1yrs)  of 'offence' its not worth it and if you lose said appeal it will cost your dear in terms of additional wages grabbing and court fees. and extends the time it shows if you lose too. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have received a copy of the Defence and the Allocation Questionaire on the 1st July, I've got until 19th to return it. I've been reading about Reload's victory, really excellent news, a great inspiration for us all!!

Just a quick update, I received a copy of the Bank's Allocation Questionaire yesterday with a letter asking me to send them (the Solicitors) a copy of my AQ, is this normal practice?? I haven't taken my AQ to the court yet, as I was struggling to find the £100 fee, but I have it now and will take it tomorrow.

Hi Everyone

I have received a letter from the Courts today, and I wondered if anyone had any ideas what it means???? It basically says:

"Upon reading the file, its ORDERED that both partners do file a time estimate for the final hearing on 8th August"

 

Help!

It sounds to me Barty as though the 8th August is the date for the hearing.

 

If I were you I would phone the court on Monday or better still if you can go down and find out more, but I think it means is that date suitable to both parties.

Just wondered if you rang the Court to see if that is the Hearing date Barty. I'm at a similar stage to you but there's a 2 week backlog at my local court and my claim is still with the Judge.

Well I rang the Court yesterday, and they told me I had to send a letter to them advising how long I thought my case might take, I had to get it to them by the 8th, so luckily the 8th is not the court date. I have heard nothing from the Solicitors at all. How are you doing?

Barty how are you supposed to know how long your case will take? If they send me a similar letter I'd just have to guess. Since I only have my statements to show and recorded delivery slips of proof of posting (the letters sent to Lloyds) prior to making a small claim, mine should take all of 15 minutes tops! I'm tempted to send copy statements to the Judge to back up my claim beforehand, while Lloyds are stalling with their 'month delay' yet not making any attempt to negotiate.

 

I'm still waiting for statements for May 2000 to August 2001 which Lloyds haven't yet sent to me, the 40 days limit under the Data Protection Act 1984 has long gone so think I'll chase them up with a view to claiming any charges back for that period, to keep me amused while I'm waiting. Hopefully our cases will be resolved in our favour this side of Christmas, otherwise I'll be using my 'refund' to pay the extortionate gas/electric bill I'm expecting in winter.

Thanks mjanet. Its weeks since I handed my AQ. in - don't remember putting any time on it (oops!) Just been reading Enforcer's thread and how Lloyds paid up

5 days before the Court hearing date. YippeeeeeeeeeeeeeeIayyyyyyy, that's cheered me up no end.

I kept a photocopy of my AQ & it was an N149. I think some people have had a different version of the form to complete. Maybe it asks for a time estimate on other forms.

Just looked at the N149 and it doesn't ask for this information so should be added to part G ' other information that will help the judge manage your claim' this is not in the libary so I will ask jonni to add it .( now added )

Hi Barty. My hearings on the 1st Nov. Have you been asked to provide a schedule of how the amount claimed has been calculated to all parties?

So much for the bank deferring the hearing date to negotiate, as they haven't bothered, suppose they're hoping I'll give it up as a dead loss (yeah right!)

Letter from Court is dated 12 August but I received it just over a week ago. I've got until the 22nd September to send copy documents to Court and Lloyds. It says Witness statements must be included in the documents filed so that'll be interesting as Lloyds TSB have stated they have a witness.

 

I've only sent a copy of the statement entries before now with the charges I'm claiming underlined so I'm having to trawl through and pick out the ££ I'm claiming and list them again for this schedule of amount claimed. Roll on November 1st is all I can say. Planning to ditch Lloyds after this fiasco, I've already set up another bank account.

Good News!!! :)

I received my settlement letter in the post today!!! :grin: :grin:

Exact amount that I was expecting, I'm totally gob-smacked!!:o

I have signed the letter and sent it back, so money should be in my account by the end of the week hopefully.

Many thanks to everyone on the site, I couldn't have done it without you.

Good luck to all of those that are still claiming, it's been a very long wait, but worth it in the end.
