Hi,

Can anyone point me in the direction of a letter to send to Citicards to have the stay imposed on my claim listed?

 

The details of the claim are as follows:

 

I put in a claim to Citicards which went to court stage, they had already made a partial settlement of the claim and made another partial payment because the court date and put in their letter to me and to the court that the claim was paid in full. However it was not full payment but the judge sent me a letter saying that the claim in stayed because it appears that full payment has been made. My court fee was also not paid.

 

I have since had further charges applied to my account. I have written to Citicards about this but they have not had the decency to reply.

 

I now feel that they should apply to have the stay lifted as in not doing so they are misleading the court into believing that the claim has been paid in full.

 

Does anyone have an address for Citicards other that the PO Box No. at Salford. I have a name of the solicitor but all letters to the PO Box address have not been answered. I am not very good at wording letters and would appreciate a little help in wording the letter.

Hi Tink.

 

If the court accepted Citi's statement that the claim had been settled, then the claim should have been discontinued not stayed.

 

You should have received an order from the court which will state exactly how the claim was dealt with. If you don't have an order from the court you should contact them and ask what the status of the claim is.

 

If it has indeed been stayed and you want the claim to continue. then it is up to you to apply to have the stay lifted,

What I have is a General Form of Judgement or Order which says:-

 

To the Claimant

 

Before DISTRICT JUDGE XXXXXXXXXX sitting at XXXXXX County Court, xxxxxxx

 

Upon referral

 

IT IS ORDERED THAT

 

1. The claim is stayed because it appears that full payment has been made.

2. Your request for judgement is returned herewith.

 

and that's it!

 

I really want Citicards to apply for the stay to be lifted under the premise that they are misleading the court by letting them believe that it has been paid in full.

The important phrase seems to be 'it appears'.

 

I really want Citicards to apply for the stay to be lifted under the premise that they are misleading the court by letting them believe that it has been paid in full.

 

I'm sure you do but I can't see Citi even responding to you, let alone agreeing. As you are the instigator, it's you who must apply.

 

In the circumstances I think you should contact the court and ask them if they will accept a letter from you as an application to lift the stay. If not you may have to submit an N244 for which there is a fee of £35.00 (reclaimable from Citi if you succeed).
