    • it is NOT A FINE.....this is an extremely important point to understand no-one bar a magistrate in a magistrates criminal court can ever fine anyone for anything. Private Parking Tickets (speculative invoices) are NOT a criminal matter, merely a speculative contractual Civil matter hence they can only try a speculative monetary claim via the civil county court system (which is no more a legal powers matter than what any member of Joe Public can do). Until/unless they do raise a county court claim a CCJ and win, there are not ANY enforcement powers they can undertake other than using a DCA, whom are legally powerless and are not BAILIFFS. Penalty Charge Notices issued by local authorities etc were decriminalised years ago - meaning they no longer can progress a claim to the magistrates court to enforce, but go directly to legal enforcement via a real BAILIFF themselves. 10'000 of people waste £m's paying private parking companies because they think they are FINES...and the media do not help either. the more people read the above the less income this shark industry get. where your post said fine it now says charge .............. please fill out the Q&A ASAP. dx  
    • Well done on reading the other threads. If ECP haven't got the guts to do court then there is no reason to pay them. From other threads there is a 35-minute free stay after which you need to pay, with the signs hidden where no-one will read them.  Which probably explains why ECP threaten this & threaten that, but in the end daren't do court. As for your employer - well you can out yourself as the driver to ECP so the hamster bedding will arrive at yours.  Get your employer to do that using the e-mail address under Appeals and Transfer Of Liability.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just called Norwich union, apparently these are the underwriters of my life insurance policy that these muppets set up. First of all the customer service from NU was appalling, rude, none helpfull and all she kept saying was that they underwrite for a lot of companies and that i should cal welcome, it was though she had received many phone calls like this and was fed up with answering them. It was only after some argueing that i was put through to someone that could help, and guess what!.............they were was based in another country. Anyway they cannot find any details of any insurance product for me. Could just do with some advice on what to do next in relation to this policy. I have SAR`d welcome this morning.

 

 

easiest and least stressful way to do it is...

 

go to the contact us page on the website - then email them bascially saying you are trying to track down a policy as you are told it's under written by them so you would like some details.

 

Keep it breif and polite - give them your address (the one that welcome would have given them just incase it's changed since) and your DOB.

 

If yours is like mine - I received an email back from a manager weeks ago saying they have no record of any policy. Got it in writing - thats what you need.

Thanks for the advice guys, i have just sent an e-mail to norwich union help desk requesting any info they have on any policies that i have with them, im also going to SAR them to make sure they respond. Is there any steps i can take with "the direct Group" who apparently admin the policies or will i hit a brick wall with them.

In my insurance booklet, that by the way is obviously cheaply printed on a4 paper and stapled together, looks like its been put together by a 5 year old. it clearly states that norich uninon underwrite the policy and direct group adnminister the policy and has the address and phone number for any enquiries for direct group. Can i assume that From reading previous posts it sounds like the direct group dont receive payment for there work in setting up the policies, norwich union dont have any info on policies that they underwrite therefore no policies. If these theories are proven to be correct how much of a bearing can it actually have on the agreement. I ask because my loan is for £17000 but my life insurance policy is only £180; obviously the 180 makes my loan completely wrong but is it enough to make it unenforceable or would a courts just award us the premium back and force us to sign a re-written agreement. I know these questions have probrably been answered earlier in the thread but im just trying to understand it laymans terms ..... you guys have done a truly brilliant job in the pursuit of bringing down welcome and should be applauded by all.
