From there you can check if they are correct about your specific meter .. https://www.legislation.gov.uk/uksi/1998/1566/schedule/4 If they're telling porkies then you have e clear grounds to tell them to take  hike. If they're correct or if you haven't been able to confirm then you have  few options. You could just keep fobbing them off. In general Octopus can't keep up with demand for smart meters. It took 9 months to get our. So they may not push too hard. Or ask if you can install your own choice of meter. The Electricity Act 1989 cover this in Schedule 7 (2) and (2A) https://www.legislation.gov.uk/ukpga/1989/29/schedule/7 Or fight the them and their enforcement. Or go off supply.
    • We received a copy of the completed Directions Questionnaire (N181) from the solicitors along with a draft copy of their directions. I am on a course today so can upload over the weekend if needed. By 4pm on 16th May both parties must each give standard disclosure of documents by way of list by category. By 4pm on 30th May any request for inspection or copies of docs must be made and compiled 14 days thereafter. I will provide more over the weekend.

    • I (and other respondents) always advise “not getting caught in a lie” it hardens their response. Why would they now believe protestations of remorse and “I won’t do it again” if they've already seen you'd lie and say it was a one-off when it wasn't..  You can try approaching the prosecutor on the day, but "I wouldn't hold my breath" …..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The last rat thread was closed down literally seconds before I could post my final word.

Please note: This thread will be also closed if there are any nasty personal comments.

Rats are actually clean creatures and unfortunately since they used the sewer system as their home and network picked up a lot of fleas, bacteria and viruses that resulted in the Black Death etc.... (Note it was a long time ago - let's move on!).

I looked at some in our local pet shop yesterday and spoke with the attendant in order to get a new perspective on this thread for the benefit of you all (thanks Monty - not at all (cough, cough)). They sell about 3 rats a week and they are as popular as mice and gerbils, rabbits do much better though with sales of 5-10 (very cute). There is also a National Rat Club which is for people interested in rat shows that cater for the various varieties and breeds (Gilbert may be interested! lol).

I was tempted to buy a rat for our boy (who is 3) but my wife would have none of it and also mentioned the rather negative aspects associated with these rodents. She threatened to move out so I had to back down.

My view is that the bubonic plague seriously dented it for rats as far as PR is concerned, but as pointed out above they are animals that should be treated humanly.

I note with interest (and amusement) that my posts on consumer issues has previously resulted in few +ve reputation comments but I have received two on my rat views. I would like to thank those who posted +ve reputation comments, but would welcome more (please).

If the flea was carried on the rat and the rat got here on a boat it seems that we are somewhat guilty of spreading the plague unless of course rats can build boats

Just to be clear, bubonic plague is only carrired by the Black Rat, (sometimes called the 'ships rat')

 

Black rats were responsible for spreading the Bubonic Plague during the Middle Ages as they carried the flea which transmitted this disease. In most parts of Europe black rats have been completely eliminated, but are still common in port areas where they find their way ashore. They are associated with man to a greater extent than the brown rat, but have a greater need for warmth and hence do not tend to occur in the open in central and northern Europe, but are more common in tropical and subtropical areas. These little chaps are really acrobatic using their tails as balancing poles holding them stiff in the air

 

 

The common rat in this country is the Brown Rat.

The brown rat can be found native through out the UK and tends to be heavily populated when living close to man in urban cities and towns.

The rat attains sexual maturity early in life and the new born are dependent upon the mother, rats therefore have well developed nests with the new born being weaned after 3 - 4 weeks. The litter size does vary but an average litter size is 8 with approximately 6 litters per annum. Again rats have well developed front incisors for breaking down food sources, but these teeth keep growing and rats have to gnaw to keep these teeth from becoming to big and this creates a lot of damage especially when in a property.

 

Rats carry a disease which can be passed to man called Leptospirosis otherwise known as Weils (pronounced Vi - ells) disease and this has proven to be fatal to men who have come into contact with rats. This disease is passed to man via the rat’s urine so protection is essential when dealing with rats. It is estimated that one third of the rat population carries this disease and there is no way of knowing which rats do and which rats do not present a threat.

So are you saying that the brown rat could not have carried the fleas that caused the Black Death? Surely there were brown rats around back then - possibly the black ones were stupid enough to get caught!

I am no botanist but I doubt if a flea could discriminate between a black and brown rat. For a start they can't see............

Could you also clarify if the black/brown rat situation is similar to the problem we have with red and grey squirrels (one of more aggressive)?

I do not want to digress from the rat discussion but there could be a precedent with the squirrel dilemma.

Yes! Barstewards! I hate them with their long tails and their stupid twitchy noses.

Plague is not really an issue in this country - but Weils disease is. I've looked after a number of folk who have contracted it and believe me it is not pleasant and can be fatal.

 

I'm for anything that controls the population of rats....from a public health viewpoint.

Why? They don't have a nervous system capable of feeling pain from this; so why is it cruel?

 

 

Oh dear - here we go again :confused::-( ! I don't feel the need to go off on a tangent discussing the moral implications of whether it is right or wrong to treat a living creature in this way - whether it feels pain or not - its wrong for me - and I am assuming you are referring to various studies - particularly the Norwegian one in 2003 saying that they do not have enough neurons to feel pain....is that really the issue - even assuming that this is correct and I wouldn't wanna bet my karma on it, frankly :eek: ! There is a great saying that we all should apply to our lives - and I am not in the least religious in saying this - do as you would be done by - its a good rule for life....all life !

I was listening to the radio today and they stated that a single pair of rats can breed in excess of 2000 decendents in 1 year.

 

Apparently there are more rats than ever now and its due to milder winters so they are not deterred from breeding at any point in the year.

 

My favourite rat is splinter, oh i was always quite fond of Ben too.

Another good fact is why rat poison works so well is that it thins the rats blood and they are very clean animals and when the preen them selves they scatch with there feet.

if they get a nick from there claws as you might when shaving they simply bleed to death.

 

if you have a rat infestation they should be removed before poision is put down and only put down as a precautionary method so they dont return.

As if they are still nesting in your house and they are poisioned they can craw under the floor boards or in the walls and die and they stink.

 

If you do have an infestation you can reclaim the cost of getting rid of the infestation from your local council even using a contractor of your choice.

Obviously discuss this with them before assuming they will pay but im pretty sure that it is the case.

I have always had pet rats. We have one now. George. He is lovely.

 

Pet rats are excellent to have with children. You can train them. When ours is allowed to run around, he always comes back if called.

My DD is training him to do all sorts of tricks at the mo, which he does!

 

He is very much a family pet.

 

It was a vet who recommended we get one, as they love to be handled, it is extremely rare they bite. I have never had one bite. And they are awake all day with the kids.

 

I agree wild rats need to be sorted out, but humanely! And pet rats are nothing like wild ones!!

I have had rats, hamster mice and gerbils and lots more. I would never give a hamster or gerbil to my kids.

 

Rats are great for interaction with kids and also with husbands especially when they were pertrified of them until one of them took a shine to him and sat on his shoulder every day.

 

mice don't do very much but help children with responsibilty and never been bitten by one.

 

Also rats are great for keeping mother in laws away!

 

When my kids start asking for wee animals I would only ever consider mice and rats

Yes, it was on Radio2.

 

There are estimated to be about 200 million wild rats in the UK and councils who only collect garbage once a fortnight were regarded as partly to blame.

 

Nobody has said pet critters should be exterminated but wild rats are a menace to public health and something needs to be done about it RIGHT NOW!

 

THIS RODENT REVOLUTION MUST BE ADDRESSED OR WE WILL ALL DIE!

We all agree that pat rats have a place in our home and heart's alongside the cat, dog, rabbit etc. Unfortunately the wild varieties of all the above can be a menace and the previous threads have all agreed that only humane methods should be used to eradicate them.

 

Let's get back to banks, credit cards and the despicable American Express.
