Failure to comply with Traffic signals, Time limit???

I have just recieved a letter saying a have faied to stop for a red light, this happened in July. Is there a time limit in which the police can impose a fine and penalty points??

if it was a camera photo

they have to reply with notice of intended prosecution with in 14 days

Even if it wasn't a camera photo they still need to serve that Notice of Intended Prosecution within 14 days of the offence.

Just for the avoidance of doubt. the first NIP (notice of intended prosecution) must be served on the registered keeper within 14 days of the alleged offence. If the Police can show good reason why they could not have met the 14-day deadline (eg wrong address at DVLA, newly acquired vehicle, etc.) then the Court will not reject for out-of-time NIP.

 

Any subsequent NIP arising from the first has no defined time limit.

 

What was the exact date of the alleged offence in July? The Police have only 6 months to lay information for a summons - beyond that date, you cannot be prosecuted. On what date was the NIP served (ie delivered)?

 

Lastly, even if the NIP is invalid, it does not resolve you of the responsibility to respond within the 28-day deadline to the S.172 request for information about the driver. However, don't respond until you have posted the dates concerned and taken advice here.
