This thread has been a focus for many.

Personally I think those who have been contributing from the start and remained supportive,deserve to be considered better than this.

I am not party to the situation or what has developed,but those who are in a position to give an update,should have been mindful of the very ethos and reasons for CAGS existence-just an update even without giving anything away would not have gone amiss.

This has been a show of extreme disappointment for many and shows some replication of the same concerns raised elsewhere on the site.

Just a reflection of society, Im afraid. People take what they want and dont necessarily feel obliged to put something back

 

CAG long ago ceased to be a penalty charges advice site. The site can never be a complete legal aid service. When we were doing batlle with the Banks on a daily basis, we shared and pooled intelligence for the benefit of others.

 

Thare was a clear common aim that united all of us.

accurate reports of what happened in any given situation and the reasons given help us to refine the advice given. often most of the cases we advise on won't have real precedent and won't be reported and so first accounts really help.

I've heard from Fred that there is to be an appeal hearing on Friday 8th October in Exeter. His very experienced McKenzie friend will be accompanying him. Everything is as ready as it can be.

I'll let you all know the outcome. All my fingers and toes will be crossed as I guess lots of yours will be.:grouphug:

It was stupid thing to do to start with, so doubly stupid to make a cause celebre of it, as if there were some sort of right to be stupid.

 

I am not so surprised if a judge would rather have none of it.

Do you intend to send a message to the effect that it's a sensible thing to do, to break out of a car park if you're stuck, or is it correct to defer to the authority of the management?

 

That is the sort of question that a judge has to sleep with, so to speak.

Of course you are free to express your opinion,but its not really helpful to anyone to be making comments like this.

Im really shocked by the turn this thread has taken with the last lot of postings.

 

This is a matter that has gone on for a long time, it has been complex at the best of times and there have been numerous delays along the way when no news has been released by those who have been involved.

 

This matter was, as far as we know, last in court only 4 weeks ago and there have been a couple of comments from those involved to say that the matter was concluded and that judgement was expected to be revealed the following week. However, knowing how this case has been shaped over the time it has been running it would not surprise me if there hasn't been a delay.

 

While it would be nice to be kept up to date with the current situation is it really fair to post some of the things that have been recently because the thread hasn't been updated? I just hope those who have kept things updated aren't scared off from porting the eventual outcome - if they can based on whatever the outcome of the case is.

But the barrier was already damaged.

the barrier was a hydraulic barrier not an electric one and so the damages claimed from Fred could not possibly have been done by Fred.

 

How hard were these two points for anyone to understand be they yourself or a Judge? Most of us picked up pretty quickly that something was rotten with the whole case, the way the claimant behaved simply vindicated our initial concerns.

 

One has to hope that the learned Judge was able to take on board a few simple facts such as:

The barrier was already damaged.

The damages claimed can not be done to the type of barrier in place not by Fred not by anyone because that make of barrier simply does not utilise the parts claimed damaged.

The claimant repeatedly provided false information under a statement of truth.

The police did not feel any criminal act had been committed.

etc. etc. etc.

 

Suggest you re-read the thread in its entirety.

As of 03/03/12 please do not under any circumstances wait for my further input or guidance on any current thread or defence of a court claim I might have been involved in on or through Cag.

Were I to go to court to lodge a claim my preference would be to win.

 

Were "methinks" to undertake to cover the cost of a lost case the opinion of "methinks" would count for that much more but that is not going to happen, is it?

The judge has the benefit of hearing the other side of story. That is how the system of justice works in the UK, as an adversarial contest.

A few weeks later he was arrested and charged with criminal damage, for which he accepted a caution.

Perplexity, if you had bothered to read the thread you would have seen that the police involvement was not as it initially seemed.

 

Then again, since your only motivation appears to be to disrupt, rather than make a meaningful contribution, an understanding of the issues involved is hardly likely to be a priority for you. Any further behaviour like this is likely to result in moderation.
