Have you a contingency plan should LD/the college/Insurance company drop their court claim at the very last moment.
I would think TLD has this covered. However, for the benefit of the ever present Guests, here's a possible clue:

Yes.

 

CPR also gives Fred the right to apply for any notice of discontinuance to be set aside. They were offered a chance to discontinue but instead chose to amend the POC and pursue the claim, this might turn out to be a very poor decision by the claimant.

(1) Where the claimant discontinues under rule 38.2(1) the defendant may apply to have the notice of discontinuance set aside(GL).

I was wondering the same. What If the Court doesn't allow them to discontinue? Would that be good or bad for Fred?

 

I think there's a chance with what has been brought to the attention of the Court that discontinuance might not be an option for them. It's to do with the overriding principles......

 

If the Court refused them or accepted an application by Fred that any notice of discontinuance be set aside this is doubly good for Fred.

 

1) It is very much to his benefit that this is heard before a Court and subject to a Judicial decision.

 

2) The Court refusing or acccepting a petition from Fred will imply that like everyone who has read any more than two posts on this thread the Court have seen sufficient proof of what might be tantamount to malfeasance that they believe the hearing is in the best interests of justice. (See 1 above). So yes very good for Fred as it means they are alert to his concerns which lets face it they appear to be as of the latest order.

You have the right to food money.

If you don't mind a little investigation, humiliation, and if you cross your fingers rehabilitation..............

If it's not too cheeky could I trouble someone who knows what's going on for a summary of recent events? You all seem very happy but I'm struggling to follow it after 86 pages.

the short 1

 

fred parked in the car park

 

barrier would not raise when he tried to leave

 

he spent some time trying to find someone , no luck

 

( barrier was NOT IN THE REST PLACE )

 

after trying everything to find some one he carefully lifted the barrier and drove out ,

 

the college crowd and there legal reps trying to [problem] him for damaging the barrier

 

BUT there is video evidence to show he didnt and actually did as said above,

 

but you really need to read all the posts to get the full picture

 

now all together say " FREE Fred he is Innocent " :rolleyes:

Hi Zamzara, Kiptower's done an excellent summary and I just want to add that there will be a certain amount of confusion for now, because there are some sensitive matters that are not being openly discussed at the moment for obvious reasons, but if you can bear with us, all will be revealed asap.;)

My daughter, (Annushka on the thread) who knows Fred, has decided that Mark Addy most closely resembles him. This may be a fitting choice as Mark Addy has already played someone called Fred once.:D

Fred is not amused as he does rather see himself as a Tom Cruise type, as AT pointed out.

I think Robert Carlye could be a good choice myself.

Well, I think we all agree that the Muppets should be booked to play LD.

 

In that case, we'll need some real specialists to play PCAD and associates:

The one in the middle is playing the Geezer from the dubious Security Company at the moment when PCAD realised the mess he made of the quotations and dates.

 

That just leaves us needing somebody weird and theatrical in a wig to play the Judge:

If I have a say in the casting, I'd rather be lifted by Brad Pitt if it's all the same to you, Patma. :razz:

I'm sure Fred would agree with you, he'd definitely prefer to be seen as a Brad Pitt type than someone from the Flintstones.

 

BRW you've obviously got real casting ability. Who's going to play you?

As for Van Damme, what an insult! Is TLD a cokehead in love with himself?... Ok, maybe he is :shock:, but for him, I'm thinking Ralph Fiennes or maybe Stephen Fry. :razz:
