    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

They are saying that they dont want me to proceed with the application to strike out the defence and to inform the court that I do not want the hearing to go ahead. I'm thinking about that one because the timescale is so short and I don't know at the moment what to do for the best.

I have today received a cheque, as yet uncleared , from the Defendant in the sum of £10,878.97 which I have accepted in principal as settlement of the part of the claim relating directly to bank charges.

The Defendants representative has requested vacation of the hearing on 17th January 2007. I do not accept this request as disclosure pursuant to the request made under Part 18 would I believe bring this litigation to an end.

The Defendant believes that the Request for Further Information now falls away as the Defendant has settled part of the claim. The Claimant believes that The Request is still relevant to the outstanding matters and on this basis I respectfully request that the applications be heard as though partial settlement of the claim had not been made.

Please ensure that this letter is placed before the District Judge prior to the hearing on 17th January 2007.

I think you have covered 'all the bases', it demonstrates to the court you continue to be serious and resonable in your claim, and furthermore the bank have in effect conceeded on the charges issue. This is excellent progress, congratulations.

My advice has hardly any legal foundation whatsoever, however you never know it it might just work!

The claim is in Sharons name as she was the original account holder. It only became a joint account after we got married. The charges started to accumulate when Sharon was the single account holder but as a party to the account she is able to claim for the whole period

I think that you have it spot on Paul, there is still the "other matter" to be settled and if you dont have this hearing they could drag arguments out for years, they will probably meet you on the court steps with another big fat cheque :D

Still at the travel agents same as mine cos me and the guvnor cant decide where to go. She wants to go to New York but I'm not so keen cos we only went a couple of years ago and also it's not very child friendly.

With one foul swoop of his trusty sword of litigation, the Cobbettslayer sliced off the right arm of the wicked witch of the NatWest. With money haemorrhaging from the near fatal wound, the Cobbettslayer took one step back to survey his neat yet fearless handiwork. With the assembled audience of lesser mortals baying for the death of the wicked witch and the almost certain end of her evil and greedy regime our superhero thought for what seemed a lifetime but in reality was just one nanosecond. Should he stay in the arena and finish off this evil monster or should he go home and have another cup of tea and a bun.

Great news. Great result. Great story.

Here's the next gripping installment as popped in the post today to NW Customer Relations.

 

I have today received a cheque from RBS Group Litigation Department in the sum of £10,878.97 in settlement of my claim for recovery of unlawful bank charges.

This settlement does not address the issue of charges added to my account since the commencement of my claim, a total of £148.12.

Clearly it would be senseless to resort to further litigation to recover this amount, although I am prepared to do so if necessary. In order to avoid such action, I require reimbursement of the aforementioned sum within 7 days of the date of this letter. If the full amount is not credited to my account within that time I will issue further proceedings against you. I believe that there will be a further charge of £28 to be applied to my account on 21st January for “unauthorised borrowing”. As this “borrowing” is made up entirely of the charges I am requesting be reimbursed, please also confirm that this charge will not be applied, as it will only result in further unnecessary correspondence.

I look forward to receiving your response before 20th January 2007.
