      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Here's the next gripping installment as popped in the post today to NW Customer Relations.

 

I have today received a cheque from RBS Group Litigation Department in the sum of £10,878.97 in settlement of my claim for recovery of unlawful bank charges.

 

This settlement does not address the issue of charges added to my account since the commencement of my claim, a total of £148.12.

 

Clearly it would be senseless to resort to further litigation to recover this amount, although I am prepared to do so if necessary. In order to avoid such action, I require reimbursement of the aforementioned sum within 7 days of the date of this letter. If the full amount is not credited to my account within that time I will issue further proceedings against you. I believe that there will be a further charge of £28 to be applied to my account on 21st January for “unauthorised borrowing”. As this “borrowing” is made up entirely of the charges I am requesting be reimbursed, please also confirm that this charge will not be applied, as it will only result in further unnecessary correspondence.

 

I look forward to receiving your response before 20th January 2007.

I'm already damaged James;)

 

Thing with that is you can normally only get exceptional damages if the case actually goes to court which is very unlikely to happen.

 

I have been off work for the last 3 months with a stress related condition, in part (not entirely) due to the pressures of making this claim. I'm sure that I could try and claim something for that and the effect it has had on my family but to be honest, I don't think it would benefit anyone if we all started trying to hammer the banks for financial compensation for what is little more than having to think for ourselves.

 

If we all focus on the point in question, get back what is rightfully ours, without trying to take the mickey, the banks will roll over sooner rather than later. If we push the point too hard they might just get the hump and risk going to court.

With money haemorrhaging from the near fatal wound, the Cobbettslayer took one step back to survey his neat yet fearless handiwork. With the assembled audience of lesser mortals baying for the death of the wicked witch and the almost certain end of her evil and greedy regime our superhero thought for what seemed a lifetime but in reality was just one nanosecond. a) how far back did your claim go?

b) Did you ever have to attend court, if so, what happened?

 

Im at court stage, claiming back to 1990 and I think there may be a hearing as Halifax defended. They have paid me £900 for the last 6 years but defending rest. Only comes to £2000 extra. Nothing to them!

I have been reading this site since about August and dont ask me why but until know I have not read your story in full.

Now I cant keep away. Well done for the cheque you received, but is there a reason they have sent it and not settled the rest? Think hard and dont be too complacent there could have been a good reason for it.

The plan for Wednesday is to go to court and still push either for disclosure or for the judge to strike out the defence.

 

I'll tell you more on Wednesday as we all know that this site is read by Cobbetts and I want to keep them on the back foot. I do believe that what I have should be sufficient but it still hangs on the Judges opinion.

 

I'm sorry to keep you hanging on like this but I don't want to take any chances on Cobbetts knowing what I intend to argue before the hearing.

Had an letter from Cobbetts this morning enclosing their schedule of costs for defending the application to strike out the defence.

 

It comes to £512 inrespect of preparation plus an unspecified amount for the hearing itself.

 

I'm sure that this is just a scare tactic in the hopes I'll withdraw from the hearing but does anyone else have any thoughts?

its just a scare tactic Mr Slayer Sir, I don't think that a judge would award such costs against a litigant in person.

 

anyway, if they are sending you a quote for their time, they cant add "unspecified" costs.
