Bailiff question

Hello everyone.

 

Can someone please give me some accurate advice for a family member.

 

Does a bailiff have the right to enter a private secure car park anD either clamp or remove a new car that is subject to a new HP agreement.

 

Its an outstanding council tax issue.

A council tax bailiff must be a certificated bailiff and he has a right to enter a property without permission. He cannot break & enter a secured car park if it is locked. No goods or vehicles subject to a finance agreement can be levied by a bailiff. The goods usually remain the property of the credit provider until the final payment has been made.

well the car park has public entrance. Still if you say that the car can not be taken as it is on hire purchase - hopefully there wont be an issue.

 

Are you 100% certain about that.

Vehicles subject to finance can indeed be taken.....however those subject to Hire Purchase cannot be taken.

 

Our office had seven queries this week on this very point and EVERY car was released.

if i were you. i would get the car put into someone elses name. they cannot take it then.

It already is. If the car is on HP, then it is owned by the finance company until the final payment

The log book or v5 should show a differant name.

I just got a spanking new van on 3 years finance....the v5 is in my name.
