Hello everyone.

 

Can someone please give me some accurate advice for a family member.

 

Does a bailiff have the right to enter a private secure car park anD either clamp or remove a new car that is subject to a new HP agreement.

 

Its an outstanding council tax issue.

A council tax bailiff must be a certificated bailiff and he has a right to enter a property without permission. He cannot break & enter a secured car park if it is locked. No goods or vehicles subject to a finance agreement can be levied by a bailiff. The goods usually remain the property of the credit provider until the final payment has been made.

Vehicles subject to finance can indeed be taken.....however those subject to Hire Purchase cannot be taken.

 

Our office had seven queries this week on this very point and EVERY car was released.
