      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I phoned the Halifax last thursday asking for last six years statements, the guy said there would be a charge of £5.00. I told my daughter who phoned the same number, and she had hers for nothing! (gutted), anyway they arrived monday in 37 envelopes.

I used the spread sheet to work out the interest and have sent a letter (recorded) today requesting payment in full, total £692.46.

People in the office where I work think that I've got no chance, and starting to make me doubt myself, but hey S.O.B. Will let you know how I get on.

Why don't you make a small bet with your work colleagues. Use half of the proceeds to buy us a book voucher.

I'm waiting for my statements for between 2000 & 2003. £5 charge went out of the account quicker than I could put phone down and login to my account. Figure for 2004 to 2006 is currently £900+. Will update forum when calcs completed and letter sent.

 

Wife was sceptical also, until I showed her this website.

:D did you know they can not make you pay for your statements they tried it with me and just quote the data protection at them they run and print them off faster than they can make a coffee

Guys, as has already been stated please don't hijack threads.

I received a letter from the Halifax customer complaints yesterday (29th march), as follows:

 

Thank you for your recent letter. I was sorry to learn that you are unhappy with the service provided by the Halifax.

 

We are keen to deal with your concerns and are currently investigating your complaint regarding the charges debited to your account. You will receive our full response shortly.

 

You will find enclosed a copy of our leaflet, which tells you how we will handle your complaint. Your concerns will be dealt with as quickly as possible, but if you need to speak to us in the meantime, please telephone us on 0141 204 6451.

Send an LBA letter from the Library. If you get nothing after that, then file a claim

 

Thanks but in my haste I sent the LBA letter first and then saw the other letter, doh! (any ideas) help!!!!!

Ah. if youve already sent the LBA you have 2 choices.

 

Send another one so that they have had a combined 28 days to respond or go straight to claim filing.

 

Which you do is up to you.

Hi, everybody, I had a phone call in work on the 10th april with a nice lady asking me if I could speak to her, I said no as I was in the office. The next day I received a letter with an offer of £90.00 in full settlement if I signed the yaadaa yaadaa. I sent them a fax saying no, I want the full amount £696.00, didn't get anywhere so filed a claim today which cost me £80.00 (hope it doesn't make me go overdrawn), now I'm praying that I get it back. Will let you know how I get on.

I checked my bank account this morning to see if my wages had gone in and nearly had a heart attack, I thought I had the wrong account!. They said they were going to defend the case fully but paid up with 13 days to go. I haven't had a letter explaining their reason yet.

I would like to thank everyone for their help and advice on this marvelous site and would advise anyone to stick it out, (my bottle started to go until I paid £80 fee to the court, and then nothing would have stopped me). Everyone I see I tell about this site, and now that I've won my money back (£776) they're all starting. Good luck to you all.

Request for Repayment of charges sent to GE money (Monsoon) sent 28th April

LBA sent 12th May

Called GE Money who denied receiving any correspondence, cheque should be sent out in the next 7 days...

Cheque received 7th June
