Hi everyone,

 

I was wondering whether you could help?

 

I have just purchased a used car, part exchanging my current car and have already paid the balance to the dealer. I am due to collect the new car tomorrow, but today was involved in a bit of an accident.

 

When I contacted the dealer they said they would not be prepared to wait for the claim to go through as this could take a long time. Are they within their rights to do this or do they still have to honour the agreement as I have already paid the full balance?

I imagine the condition of your car was part of the contract, so if the damage is slight they may still take it subject to some adjustment?

if however you cannot actually give them the car as part exchange the deal/ contract cannot be completed and you are the defaulter.

I guess the will refund your monies paid less some sort of administation charge/fee.
