Hi Guys - I have lived in Aus for over 10 years and have some fairly large credit card and overdraft debt in the UK. I know all about the morality of walking away from it but I have a couple of questions:

Can I go banrkrupt in the UK or can they make me bankrupt in the UK as I do not live there and have not done for some time.

Can they pursue me in Australia for it.

Also if I go bankrupt in the UK can they take my company pension in the UK.

Some of the debt is joint and down the track my wife might inherit a bit of money and so hoe does that affect it. :cool:

If you have not paid or admitted the debts for those 10 years, then they surely would be statute barred...

 

 

You probably need to check your dredit file to see if any defaults or CCJs.

IMHO bankruptcy is very last resort. I would CCA and SRA them first to see if everything has been done in accordance with the CCA.

Hi Struggling

You should def do the CCA first as AM suggests. Then when they dont comply you'll have paperwork trail in case they sell your 'accounts' on to a DCA in OZ. I believe that the UK has agreements in place for debts with Australia, Canada, Germany at least.

So its important for you to go on the offensive. ( I know because I live abroad too)

All they will send is a copy, but if they want to enforce at court they would need the original document. DO NOT SIGN ANYTHING. Just print your name in future for obvious reasons. Once you get your reply from them, you can then post up the details ( Deleting your details of course) Then someone will be able to assist you.

This is all new to me - what is the CCA - presume DCA is a debt collection agency.

How can I find out if the UK has agreements in place for debts with Australia.

I agree to go on the offensive is good but not sure how!

I have debts in Aus too!

Have searched and found your story, somewhat similar to mine...

CCA is Credit Card Agreement - the original credit issuers need to have in their posession an original of your signed CCA - search these forums for the right details of this!

It is part of the 'fight' that they provide a copy of this to you upon paid request.
