    • Yes, await the Directions Questionnaire from the court. No, the Directions Questionnaire is just a short form and leads to the case being transferred from MCOL/CCBC to your local court.  If you Google "Form N180" you can see a blank copy on government web pages.
    • There will only be one hearing (typo possibly 25th is a Saturday Courts closed ) clarify with the court.
    • Upload a redacted copy of their statement (+ Exhibits) please.
    • No Andy, I'll scan, redact and upload later today. So the court sent me 2 letters, same envelope and stapled together but with different dates!. 1. N24 General Form of Judgement or Order, stating: UPON considering the papers herein IT IS ORDERED THAT The claim is listed for an attended hearing 25 May....... at which court will consider allocation..  etc   2. N24 Notice of PTR/Adjnd/Restored/Hrg/Management conference TAKE NOTICE that the hearing will take place on 24 May at....... When you should attend 30 minutes has been allowed for the Hearing   No other instructions anywhere in the envelope or on the letters. Do I attend both?
    • Then leave it just proceed with the claim( strike out/SJ application are risky).....the defendant will not be permitted to rely on written evidence (documented) only verbally as they failed to comply with the N157 (unless they have filed with the court and failed to serve you a copy) ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can any one help me my 8 year old daughter has been put forward for statementing. I have been told the process has been started does any one know how long it would take. Also would i be able to claim dla even though there is not a positive diagnosis the doctor is taking her time to diagnose aspurgers. Even though the people i talk with at cahms say that my daughter is a aspurgers child. Any help will be appreciated.

Statementing can take a while - they are supposed to complete it within a timescale but I can't recall what that is - someone else will be along shortly I hope.

 

You can claim DLA without a formal diagnosis, DLA is about the help the child needs over and above that a 'normal' child of similar age needs.

If the process has been started, it means that they are first going through something called a Statutory Assessment, which may or may not lead to a Statement being issued. When the request for Stat Ass is made, the LA has 6 weeks to say yes or not to initiate a Stat Ass. If they agree then from the day an assessment is initiated the LEA has 10 weeks to decide whether to issue statement and then a further 2 weeks to draft the statement. The final draft can be issued up to 8 weeks later depending on parental response.

 

The whole process should take no more than 26 weeks, and that is a legal requirement.

 

Re DLA, yes you can apply even without a formal diagnosis, the criteria is that the needs of the child should be significantly different to the needs of a child the same age, although I should warn you that autism in general and Asperger's in particular tend to have a lower award success simply because the kids tend not to be seen as "disabled". This doesn't mean you shouldn't apply, but simply to warn you to be ready to have to fight harder for it. ;-)

 

If you're a at home mum, or only working minimal hours, you may be able to claim Carers' Allowance as well, but you need to request the claim form separately, and don't wait until you get DLA as they don't backdate unless you have done both at the same time. They'll say no to CA until you get DLA awarded but then will backdate to then.

Thankyou for your help i didnt know what to expect all i know was my daughters doctor asked me to sign a form so she could get the statmenting process started. I was wondering if my daughter got the statement would i be able to get her to stay in the special needs school that she is already in as she is happy there and has settled.

Hi bookworm,

What happened was my daughter was having problems in her old school so they decided to permantly exclude her so she got put in to a special need. and i live in manchester:)

Hang on to that for dear life, hun. :-)

 

Once the process is complete, you'll have to make sure that the LA names that school in Part 4 of her statement, and you'll be set. If she's already there and doing well, hopefully you won't have the uphill struggle that some of us have had. ;-)
