      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi and hello all!!

 

was wondering if anyone could help,im currently been of work for a month with a broken arm, turns out its worse and i will need surgery(bone graft) , my employees wont pay ssp because i do to little hrs (15), im not eligable for income support because my partner works 16 hrs and her income is 35 pounds over the 94 something ceiling, im also not eligable for incapacity benefit because one of my ni contribution years is short, we get working tax credit and xchild benefit, but i maybe of for upto a year and need help desperatly!!! we are struggling badly already

thank you. after citizen advice stumped, and the benefit helpline thingy at a loss , ill try anything

 

we worked out our income outcome etc, the bank was ok but slightly concerned, loans however have been less then sympathetic, given me a months rest then to contact them and resume payments.

 

Im just a little shocked by this, we have been on the breadline for a year now and this has come as a huge blow, i mean i have a 10 year work history but was made unemployed in 2006 for 32 weeks, this affected my ni contribution, i cant believe that I may have to go a year with no help, and my partner support 3 of us on her 16 hr wage and working tax/child tax benefit!

I have just got a long term injury and have had to leave work, I have no income, im not eligable for incapicity benefit or income support.

 

I have a loan of 3500,a credit card for 1000 and catalouge for 2500, not a great deal i know but ive missed my loan and credit card paymen , first time, I spoke to my loan company about my injury and they informed me my insurence didnt cover me, I have just moved and the firdt two companies do not know where i am, the catgalouge does

 

Im going to be off long term i cant work and have no income and am falling deeper and deeper quickly i dont know what to , it seems to be all falling apart

Try ringing your welfare rights officer.

 

They will be able to tell you if you are entitled to anything and will also act on your behalf if you want them to when it comes to claiming your benefits.

use this calculator Start Calculation. Your tax credits should increase, if you are renting you may be able to claim some housing and counci ltax benefit, and if not renting then some CT benefit.

 

If you have a mortgage consider asking mortgage co if you can drop to interest only payments for a while.

 

If you have other debts you are going to be unable to pay then token payments may be the way forward, in any event I would find out your entitlements and then draw up a budget to see where you stand financially through this period.

Hi sorry to hear your situation. I'm not sure about the benefits folk as unless you know the system it's hard knowing what you really are and are not entitled to. The loans and the catalogue will have to accept token payments. I know that for sure. All you do is write to them (I never give my phone no) and send them a statement of means ie what comes in and what goes out. Priority bills are your mortgage/council tax/gas/electric and you obviously need money for food etc. so even if you offered them £1 a wk/month then they should accept it. They won't like it and may pass it to debt collector but bottom line is "cant get blood out a stone" so they know if they threatened court action they would be out of pocket for court/legal fees and a judge would look at your incomings/outgoings and come to the same conclusion. Court may seem scary but it is not in the slightest. I had to go recently and represent my daughter for "supposed" missed rent. I was PETRIFIED as never been in a court in my life. Crying the lot. Then done a lot of research and when I went 4 times I saw how incompetent and nervous the lawyers etc were and the judges were extremely nice and kind. They know you have fallen onto hardship through no fault of your own, however you have (which you should) contacted the companies involved and not stuck your head in the sand. In the future when your situation changes you tell them you will reassess with a hope to raising your payments. No one wants debt collectors etc involved but its getting kinda hard to avoid them these days.

I hope this helps a little and things will get better. I remember my dad saying that to me when I was in a not nice place and I thought "yeah right" Believe me THEY DO!!
