Help with dell agreement

Please can someone help me as I've got into a mess and I need some help getting out!!!!

 

On 24th July I bought a computer from Dell, they were offering 12 months interest free credit but I was told I didn't qualify for this but I could have 6 months instead. I asked the sales assitant to confirm that if I paid the full balance off before the 6 months this is all I would pay? She said that was right but unfortunatly I didn't get anything in writing.

 

I sent the cheque plus a covering letter registered post and the cheque was cashed on 3rd Jan 08. Since then I have had 2 letters in feb 08 saying I had missed a payment so I called and got told to email. So a number of emails went back and forward to CIT who finace Dell and the outcome was to get written confirmation from Dell.

 

I have since called Dell(I can't remeber the amount but its over 15) and written but no-one has replied. The account was then passed to moorcroft but I wrote to them with copies of the cheque and they then passed it back to Dell.

 

I then recieved a letter form Dell financial servcies (CIT) saying they had recieved my payment but for a lesser amount that was sent and said there was a further payment of nearly £100 to closed the account. so I wrote a letter to them asking to explain the amounts and close the account within 14 days. This was middle Sept I then got a call from them today to say the account had been passed back to Moorcroft and the amount owed now was nearly £1000!!! But each time I querried the amounts they were all different.

 

The guy did say if Dell would confirm the orginally 6 months interest free they could change the contract and close the account. He did warn me it would go to court if I didn't make a payment, which I can't afford and he pointed out the agreement they have is for 6 months deffered then 36months but interest is from day 1.

 

Please can someone advise me of what I can do? Is there any 1 I can report Dell too? I feel we've been miss sold by dell and now stuck in a mess with no way out!!

If it was me in your shoes, I would send them a Subject Access Request, something along these lines, unfortunately it will cost you a £10 postal order but at least you will know where you stand.....it sounds like there are some pretty hefty excessive charges that have been added !! send it by recorded delivery....

Subject Access Request

 

Dear Sir/Madam

 

ACCOUNT NUMBER: xxxxxxxxx (or multiple numbers if more than one account)

 

Please supply me with all data that you hold on me. This includes in particular, but is not limited to, the following:-

 

1. The original signed, executed credit agreement and any terms and conditions that applied to the account at the time of default and at the time the account was opened.

2. Transcriptions of all telephone conversations recorded and any notes made in relation to telephone conversations by your company, or by any previous creditor

3. Where there has been any event in my account history over this period which has required manual intervention by any person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my account formerly held with ORIGINAL CREDITOR.

4. True copies of any notice of assignment and/or default notice or enforcement notice that you or the original creditor sent me, with a copy of any proof of postage that you hold.

5. Documents relating to any insurance added to the account, including the insurance contract and terms and conditions, date it was added and deleted (if applicable).

6. Details of any collection charges added to the account; specifically, the date it was levied, the amount of the charge, a detailed financial breakdown of how the charge was calculated, and what the charge covers.

7. Specific details of the fees/charges levied by any other agency in respect of this account and a detailed breakdown of said fees/charges and what each charge relates to and on what date said fees/charges were levied.

8. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998

9. A list of third party agencies to whom you have disclosed my personal data and a summary of the nature of the information you have disclosed.

10. Copies of statements for the entire duration of the credit agreement.

 

I enclose the statutory maximum fee of £10. You have 40 days in which to comply.

If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.

yeaI think so unfortunatly I didn't read all the info and trusted the sales person (a mistake i'll never make again) so I do think they have an agreement which is like the guy from CIT said is 6 months defered then 36 month loan.

Just an up date and for once it's good news - YEA! I'd heard nothing back from either letter, I posted one to Dell asking them again to look into the mess and a SAR to Cit who finance Dell.

 

Then at the beginning of this week when the European compliants manager phoned me and basically admitted they had messed up. He has since put the account to £0 and closed it (still waiting for written conformation though) He is going to make sure this hasn't damaged our credit rating and he will write to the appropiate companies to make sure and he wants to know how they can compansate us for all the hassle. He had offered £100 but I have said I want to talk it through as this was an amount he picked off the top of his head (his words) How much realisticlly should I ask for?

 

I'm not at the point where all I wanted was this to end and the accoun to be closed but as he's offered it has been nearly a year of hell!
