    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

a couple of quick questions. i have been looking back over previous loans I have paid off and came across a Natwest loan from 2001 with something called Personal Laon Protector (PLP) insurance on it. I would never have requested something like this as in my line of work I could never have benefited.

 

My questions are:

Is it the same as a PPI

Can i still claim even though it's over 7 years ago,

Yup it is the same thing! I'm having a battle with Natwest at the mo so get ready to get the gloves on as they are useless!!!

 

I think you can still claim after 7 years.

 

Have you requested a SAR?? £10 and they have to send you all the documentation they hold on you. Including the credit agreement.

 

It takes a bit of time but its worth a try!

As Karen says, it is payment protection insurance and NatWest have obviously added it to your account without your knowledge or consent. Very bad practice and I'd like to see them justify such an action in court.

 

In your S.A.R - (Subject Access Request) you can request a true copy of the application form as signed by you, a true copy of the Credit Agreement, a transcript of the sales conversation if it took place over the telephone and all statements relating to all payments made on the account.

 

Even if you had discussed the PPI product with the NatWest loan person, they were still obliged to provide with sufficient info to help you make an informed decision as to whether the product suited your personal circumstances, the costs to you with or without the product, and the availability of other similar PPI from other sources.

 

Even though your loan dates back to 2001, the FSA still provided regulations and guidelines to all lenders which they are legally obliged to adhere to. We can go into this further later on down the line when NatWest have replied to your SAR.

 

Check this out from the site's ConsumerWiki: PPI It will help you pinpoint exactly which arguments for mis-selling you will use if and when you make your complaint and preliminary request for payment.

Hello woodwa,

 

You can do a search for natwest in the FSA register this is the link...........

When the link is open just type natwest in the firm name box and submit all the info will come up on natwest. If is natwest bank plc you can hit the red links on the left and it will give you details of when the company were authorised. If they were authorised before the date of your agreement I reckon you have a good claim on your Mis-sold PPI and if not the FOS would probably look at your claim if you go down the FOS route. You do have the Court option as Paintball has pointed out.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Thank you ever so much. I did as you suggested and the date is 12/01 which is after I took out the loan. I think this is going to be a long fight but that has never put me off in the past.:p

well i wasn't wrong in my last post. I feel I am no nearer a resolution. I have the original signed agreements which i found after beeing mucked around by natwest for months. I sent an S.A.R stating the usual including asking for details on any PPI (which i know to have been added to both loans). I have just received the following reply:

I refer to your recent letter regarding a complete list of transactions and charges applied to the above accounts under the Data Protection Act 1988.

 

I confirm that the accounts were opened for internal bank use only and were used solely to hold funds on your behalf prior to the drawdown of your loan. As this was not a customer product charges did not accrue and were not payable on the accounts. Please therefore find enclosed a cheque for £10 in refund of the postal order received.

I would seek clarification on this statement how the heck can accounts be opened for internal bank use only? especially as they purport to be used solely to hold funds on your behalf :eek:If they are accounts holding funds on your behalf then you should be entitled to the data on those funds or loans and therefore their refusal to supply information is in contravention of the Data Protection Act 1998.

Your reply should then be a formal complaint to the Financial Ombudsman Service. Phone them and get a complaint reference number. They will start to fill in a complaint form and send it to you to complete and sign, Then send off the complaint form with copies of all correspondence between you and Natwest every little snippet of mail both ways.

If natwest have sent back the £10 fee it would indicate they are very reluctant to release any data on you and legally you are entitled to this data. Hence the need to let the Information Commissioners Office know what is happening.

 

 

Time to make an issue on this with natwest.;)
