Just a quick question.

Have been evicted from property,a creditor has applied to the court for a charging order,the debt (12k) has been through high court. We have an agreement to pay £500/month this has been paid up to date.

The question is can the charging order still be applied even though we have been evicted?.(They do not know the property has been repossessed).

If so how do I fight it,as we have been paying the agreed monthly amount?

Do I inform them that the house is repossessed?

Goes to court on the 24th October.

They can try but it will be refused, or they may even withdraw if they find out before the case is heard.

 

You don't have to do anything now as it's not your property any more. You could do this as a matter of courtesy (that's all it would be) but I would just sit back and enjoy the spectacle - there's nothing you can do now. And nothing they can do to you.

 

As far as 'fighting' the charging order you can't. It isn't on your property.

 

Don't even bother going to court.

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.
