    • Correcting a prior post. Oliver at least got fed every day didn't he. Tories will see the kids go without food for a week or two wont they.      
    • It was because the last day fell on a weekend so they had until the end of yesterday to reply. No reply and I have Requested Judgement this morning, I have requested full payment by the 3rd November. I think a week to for the to resolve is reasonable. I don't hold much hope of them even responding to that so feel it will need to be taken further.   What is my next step if I don't receive the full refund by 3rd November?

    • Good morning,   Thanks for the reply.  This gym involves Legacy Leisure, the gym I use is Rutland Sports Park, though my account is linked to Friesland Sports Centre as that’s where I initially signed up (they have 5 different sites all working as one in this area).  It was a council owned and run gym before they brought in this third party to do it for them (and reduced the quality, but that’s a story for another day).   As suggested I have cancelled the direct debit.  I received another email last night telling me that they would freeze my account for a further 6 months for an ‘admin fee’ of £5 per month.  I will be telling them that’s not good enough.   Apparently I owe them £25 for an admin error on their behalf from about a year or so ago (they mentioned this at the time but said they would look in to it, and never mentioned it again).  I’m happy to pay what I owe outside of this £26 28-days notice fee.   So: what should I do next?   Thanks again,   Sam

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
       
      We had a 10yr  finance contract for a boiler fitted July 2015.
       
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
       
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
       
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
       
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
       
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
       
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
       
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
       
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
       
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
       
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
       
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
       
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
       
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
       
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

U can opp to home educate (HT).

 

Not sure of the HT sites but if u have a look there is normal some good advice & even template letters to withdraw your child from the school system.

 

 

Some people say it's the best thing that they have ever done, I personally wouldn't know but everything is always worth ago.

 

On the other hand have you contacted National Autistic, OAASIS,ACE (Advisory Centre for Education ), IPSEA etc.

 

They can normal help in some way

I have a 13 yr old son with Asperger and a 15 yr old daughter displaying quite obvious symptoms of the same thing (but without the benefit of a diagnosis since CAMHS seems unable to cope without a report from a school - and since my children are home educated this is not likely to happen).

 

I removed my children from school several years ago because of physical and mental abuse, about which the school did nothing despite numerous meetings etc.

 

My children have calmed down considerably since I removed them from the abusive environment I was forcing them into every day (I literally had to drag my daughter into school at times). Theyre like different people now - calm, relaxed, well mannered and polite, softly spoken and well-balanced. I just wish I'd taken them out of school earlier to save both them and myself the suffering we all went through while they were attending school.

 

The procedure is very simple - simply write a letter to the school advising that you are de-registering them. You do not need to explain why, or go into any particular detail. If you have a child who is registered SEN then you will have to write a further letter to the LEA SEN Dept to say the same thing. The LEA will then monitor the education your children are receiving at home to ensure that it is satisfactory.

 

There are many home education websites to be found; my personal favourite is Education Otherwise - Home Education Support Charity

 

Getting them back into school if you so wish is just as simple - just contact the LEA who will send you forms to complete, in exactly the same way as you registered them when they first went to school.

Wow just read through all my posts :( back again and sadly no better off .

 

Miss Boring was assaulted at school on the 16th of this month , she is still not statement as R became ill again and I could not pursue the tribunal process :(, county EP and Labbs got the same test results as private dx's but state minimum support requires, county salt requested visual aids for communication , all advice was ignored , the school withdrew all support in year six,

Miss B was assaulted at lunch time, was not seen by a first aider and was left to sit all afternoon with significant bruising to her body , When I complained the school sent home an incident report naming another child who was also assaulted and the boy who attacked her , the next day they denied this and two EWO's repeatedly questioned me in front of my 9 year old and 5 year old, the questioning was aggressive enough to make my 9 year old cry!

The school now deny any assault happened at school, they are trying to pin the blame on my 10 year old stepson who has been placed with us by social services after his step dad assaulted him.

I put in a formal complaint , the HT responded by writing a letter saying that he will not investigate as the issue has been resolved to HT satisfaction , a third of his letter was unrequested info on home schooling , school made a SS referral against us re step son having behavioral issues ( this boy has a five year documented history of behavior issues and was on sa+ at previous school )

Miss B is off school with daily nose bleeds through anxiety , nightmares that the HT is going to kill her etc , she has now not slept for 4 days straight :(

Am tired worn out and just about ready to give up :(

R is now on meds , his experiences have led to him now being dx with anxiety disorder and depressive disorder , he is coping but only just .

Hi Mina2974,

What you are describing is sadly too familiar to parents with child of dx of ASD or behavioural problems.

 

One very important thing you must learn to do & start to do it now is to be the parent from hell!!! Noone else is going to fight for you & the bottom line is money because everything your child including the stepson cost.

 

My encounter with SS was a nightmare if you have any involvement with this oh not so helpful bunch of Muppet's make sure you always have a wittiness plus document everything eg dates times person name phone calls & conversations because they will & they will twist what has been said & lie. After all they will say it's your ability to parent & what they will try & do is send you on some sort of parenting programme. That way they will say they have provided you with support.

 

With regards to the statement have you written request that your daughter is assessed under the SEN procedure?

I put a new request in for statutory assessment in this week, Miss B is still not in school, We have now reached the point where no one in the LA will return our phone calls, I can only assume that we have been blacklisted in some way *sigh

 

Have been very very careful with SW but although they are ineffective they can't really call us bad parents as they placed an extra child with us, I refuse to have my child forced out of education , Just not sure how to force the LA to communicate with us grr

Hi

If you have put in a written request for an assessment the LA must reply within a given time frame. If they fell to respond you need to go down the complaints root or phone NAS they can be quite helpful.

 

Everything you send to the LA make sure it is sent recorded or special delivery so you have proof that way they (LA) can say they never had a request. You must cover your back all the way. Try not to request too much in a verbal manner because what proof do you have that you've asked!!!

 

The golden rule is to document. Sorry I keep going on but our experience was one I would never wish on any parent.

 

The part about parenting is not about good or bad parenting what will be said is your parenting skills are not quite adequate & therefore a parenting course might be recommended eg Webster Stratton. This is total useless for kids & parents alike who have a DX of ASD.

 

I hope I'm not barking up the tree, this is my opinion gained through the experience I've had to deal with.

Again, let us know what their response to Statutory Assessment is - it will probably be "no" (default position) but I will happily help you prepare your NOA.

Hi all

 

Disappeared again sorry its so hard with the kids atm :( , situation to date is they said yet to SA, we should hear by the 20th at the latest if they are going to statement, I think that they said yes to shut me up, but got a bit more than they bargained for as I went to some of the biggest names i could afford for independent assessments. Am hoping that I will not need to go sendist but just in case Have a whole file of illegal practice that I can use .

R tired to kill him self again, he's crashing and sinking into a depressive state thats hard to cope with, funnily enough the school see nothing grr, have on record the senco admitting that she keeps kids off SA+ , so in goes another request for assessment , please keep us in your thoughts this week , I really need a yes for statement for Miss b , I have a feeling I will be pursuing SA for one and sendist for the other though .

 

For anyone new to this, get your child on sa+ , I am speaking to too many parents who's kids are being kept off this as it makes it hard to get statutory assessment approved !

Had a rather shabby attemt at a statment for Miss b , sent it back with a few ( ok a lot ) of suggested amendments , I do think we will be going to tribuanl with this, Have also had SA agreed for R , we have camhs onside to push for sen school, he's now out of school due to a total nervous breakdown involving an attempt to kill himslef , 2 stupid ss and 3 police officers restraining him

Parent bashing is still going on but no longer care, kick me and i Kick back harder :D, Have decided to move LA's at the end of this year, hear witneys up and coming and im sure DC will take good care of me mwhahahha

Nice to see u're hanging in!!!

For us that have already been through this process we know how it goes :(

My daughter is nearly 18 & it started when she was 7 1/2. Believe me the problems don't ever go away they just change & you become (or try) wiser. Me personally I have become quite good at social care law & educational law ;)

 

It will be nice if that day ever comes that ASD is fully acknowledged & the difficulties that parents face on a day in day out bases are recognized.

Round one with Education won, Miss B has a full time specialist placement :), shouted to everyone including the local MP who was so rude he was sent a slap via e-mail ;)

 

They have until July the 27th to respond to R's am hoping that they will see sense with him as well, wish me luck :)

Thank you Bookie :) , think I have got the hang of this fighting lark now, Believe nothing they say, quote case law to back up every point you make and generally make sure they know you are the pain in the bum that will keep shouting until you have got what you need for your kids :) , record everything they say and they hang themselves, We have really had some of the most incredible things put in writing to us :p

 

If only the Asd was as easy to manage, since I last posted about R he's now got 3 new dx's , anxiety disorder, depression and Pica , I had read somewhere that the traits can become exaggerated during puberty but no one said it would be an explosion lol

i read your posts with avid interest, i did send you a pm. i foun this thread as im looking at how to get the dla for my son now 15 who has nephrotic syndrome (minimal change) and has the exact same behaviours as your son due to the high dose prednisolone medication prescribed. does this sound possible to you? it does cause mania, depression and all sorts of horrors.

 

how did you manage to get dla i was refused twice its so disheartening when you need all your energy and have so much on your hands what with frothy urine, water retention etc

 

just a question does your son exhibit worse behaviours when he is hungry? mine was just awful and really self harming

 

i got him to see the sen team and be under camhs by taking him to a and e and my son told them he was going to kill himself . they took him seriously.

 

anyhoo we managed to get him off the steroids (severe emotional and behavioural side effects) and on to tacrolimus which has been great and i have my son back but now he is just relapsing so will be back on the pred...oh my god there goes my life and i have a newborn too! hell on earth!!

I think I did send you a pm but will reply on thread in case anyone else is in a similar situation, I can only pop onto the forum every now and then due to having my son at home still,

 

In hindsight R had AS well before he started showing signs of the kidney disorder , his pead feels that he was showing signs of it from about the age of 7 , but his high tolerance for pain and discomfort masked it for years, he used to wake up every morning with huge bags under his eyes but as he did not sleep more than two hours a night we thought it was due to that, My son is so pedantic and professor like that I am 100% sure that his symptoms were a direct result of the ASD not the steroids , they did make him a lot worse and I was glad to take him off them, but with his ADOS scores were very high according to camhs, the dx him in one meeting as it was so obvious that he is on the spectrum,

 

Just to update he now has a statement and will be going to specialist school as soon as we have finished arguing with county over his placement :)

Round 2 won !!!

Mina, that's wonderful news!!!

 

You know, you should re-read your thread from start to finish and see how you have changed, from a completely bewildered and hapless mum to this woman who has managed to conquer all for the sake of her kids. I am so proud of you! :madgrin:
