      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,got a loan through citifinancial in april 2007,im paying 193 a month,which is really taking a chunk,was okay at the start but now im feeling,dmp plans are basically a no go,ive tried payplan already but fobbed me off,and cccs couldnt help. Is it worth trying the offer myself,or is there any action to resolve this,

Unfortunately Citifinancial are one of the worst to deal with. You should do a budget sheet, there is one on the National Debtline which is excellent, see how it works out and what you can comfortably afford and send a letter with the budget sheet. They are not easy to negotiate with but if what you offer is all that you can afford then thats it. It would be advisable to send the payment that you intend to offer when due that way they will no your serioius about your commitments.

Hi,had a letter today from citifinancial regarding my loan,taken out nearly two years ago for 6000 with which apr added up to 11500 the grand total now is 5500 . ive paid fine till last christmas when it all became a bit much,on top of my other debts 193 a month was a bit of a crutch! So i called them up at the glasgow office,they said unless a contractual payment of 193 was paid by end of tomorrow.it will be passed onto capital collections.Of who i havent heard much about.Dont get me wrong,im willing to pay my payments,just a bit reduced! My question is now.how bad will it be,will they be knocking asking for the 5500 for what i owe in one lump sum or accept payments.

 

they dont stand a chance of getting 5500 so im asking if anyone has had dealings or know what route they will try to take or take etc.Any advice appreciated! One thing i dont want is them trying to show up at my doorstep.Theyd only cause trouble for themselves! lol

Seriously though,its worrying.anyone got suggestions

Thanks,put my mind at rest a bit,dont get me wrong,i took the loan and ill pay it back but in a fair waY.So i will discuss arrangements with them when they get in touch.Whats your advice on the offer i should make.im not saying a pound! but 140-150 is what i could do.Would they accept that do you reckon

You dont need to explain or justify yourself on here ;)

Like i say - they will accept what you offer them, if thats £1 per month then thats what it will be.

A court would have to take all your outgoings into account anyway, so if it ever went there, a £1 per month is what they could order anyway.

Hello all! I was meant to pay citifinancial,end of this month,i came short,can only pay £30. Fair enough im in the wrong,but they have rang at stupid o clock like 8.15 in the morn,and endless calling, ignore them and miss others,and they rang today at 8.10! im not dealing with them at that time,and i cant call them to explain,due to there offices are closed apparently....so how are they calling! Anyone know a complaints procedure lol.Very irritating over a payment of £100 they obviouly feel justified to hound me! Appreciate comments thanks!

Go to templates section and send them the telephone harrassment letter.

Meanwhile send them whatever payment you can afford to. At least show you are willing to pay something even if its not the full amount. This will look good for you if it goes further. Write to them and tell them about your situation.

I found the easiest way to stop their endless calls was to log on to my account on their website & deleted my telephone number - simple but effective :D

 

If you are answering their calls, you would be advised to

 

a) stop answering it if you know its them

b) refuse to answer the security questions

c) tell them to put everything in writing every time they call you.

 

If you are with BT, they have a 'Choose to Refuse' facility which you can use to block their calls but be aware that they probably have several numbers they can call from.

 

Is this an old a/c? If so, it might be worth sending a CCA request or if a recent a/c, and if there are charges on it a SAR would identify whether you can reclaim the charges.

As with all letters, send them unsigned & by recorded delivery so that you have proof of their receipt should it be needed in the future.

 

If/when you get any replies to your letters, keep the envelopes stapled to the letter.

You could always answer, and just say, 'yes just a moment I'll get him/her for you one second'

Then place the phone down on the side and keep checking it ever five, ten, minutes see if they are dumb enough to still be hanging on.

Thankfully they called earlier lol,i paid what i could and agreed what to do with the excess.I did complain about the calls,and the caller said it isnt his office thats doing the early morning calls! but hes noted it on his system,if they call again i will do what youve suggested,thanks for your suggestions,i think there should be a limit to how many times a company could call.im on the tps,which in all fairness did severly change the amount of sales calls i had.Some you just escape lol

There is, it's called the Protection from Harassment Act

the Administration of Justice Act and the Telecommunications Act

 

 

Whilst TPS works for some, it will never stop these companies breaking the law, a TrueCall will!!:D

 

Speak with your telephone provider and go through their malicious callers procedure, and report these lot to OfCom for breaching statute law.

citifinancial,

 

borrowed 5'000 high interest etc in 2007.

 

Then citifinancial stopped loans and closed there branches who dealt with them.

 

I am thinking the chances of them having my agreement after all the moving about they had to do would be remote.

 

slim chance but does anyone know what road i should take to just check that on the off chance i can write the thing off!

Ok, stop talking on the telephone and request all future contact to be in writing only. They are not so quick to make threats in writing, although they will try some may do this, might do that, could do the other!!! It is your money and YOU decide what you will pay, and when.

 

What is the current situation with Citifinancial, are they chasing? 2007 might be able to provide valid CCA.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hello everyone

i have a Citi financial loan that isnt going down at all!

i took out a loan in 2007,ive missed a few payments.hands up my fault but had a lot of debt back then.

for the last couple of months ive struggled to pay them

now its come to the point where i have the manager calling near on everyday,and there understudys asking for payment.Also have called at work a few times.that is annoying especially since i have warned them not to do this in the past.

the first time i will be able to pay is the end of december.they say they will reverse the arrangements if not paid tomorrow and then 5 installments will be due.

My question is surely they cant just suddenly decide to reverse an arrangement?

second question is it worth seeing if they have a signed loan agreement? 2007?

third question.how long until third party comes into play and who would it possibly be?

appreciated if anyone has any answers thanks
