      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The topic alone seems a bit ironic, as those 2 words do not go well in the same sentance.

 

I'm not going to give too much details about me, but i feel things just got to be said, and a rough guide to how debt is in fact not helping the economy or folk health wise.

 

I have my own medical problems, and i'm sure i'm not as bad as some folk get, but netherlsee it's there, and it's a problem that i alone have to deal with. I know i'm not alone in this fight, and that is partly what keeps me going.

 

I got chronic depressive illness / Unipolar depression , alongside Kyphosis. The Kyphosis alone is in advanced stages and makes it hard enough to walk on a good day, let alone any other day. The pain produced renders me useless, and that hurts me to the point i'm totally useless in all area's of life, hence the depression.

 

Yes, it is depression, and it is an illness, it's not just something you can make up, as i had the tests galore to prove it beyond all reasonable doubt.

 

I am still recieving ongoing help from the hospital and other medical places, this is not likely to stop or downgrade any time soon, mabee not in the next 5 years at least.

 

Most of where i'm at is a genetic condition, from birth, and cannot exactly be repaired or corrected, as it affects the spine, something the doctors are not prepared to operate on any more. At least in the UK.

 

So, you know a bit about my conditions, and now where does debt come in? Simple, being depressed and with an illness, that is not easy to diagnose on it's own merit, then adding to that preasure is the fact i'm finding things hard to understand, let alone sort out.

 

So these stupid debt companies rely on the fact i know nothing, or at least pretend to, and hope that i'll pay what they think i owe.

 

They use all sorts of tactics, hard ball and soft ball, basically the good cop bad cop routine, to make you pay.

 

WEll i got news for them, thanks to this site, i am aware of my rights, and aware i'm not alone, and also aware you bully other, possibly more vunerable folk.....and i wont put up with it.

 

I will use all, and any legal ways of my own, to prove and to make sure you get your deserves, and make sure you are either closed down, or properly governed.

 

Don't suffer in silence folk, you are NOT alone, i am with you, as is 190K on this site, and i will use my rights to protect you, and get these bad cops away:)

I have found that with knowledge gained here you can at least bit by bit start to take some control back.

;) If you keep on plodding on, one day your debts will go, please believe me, if you do not give up hope you will win. Takes years I know but believe me I have done it and so can you. It seems at one point you are getting into more and more debt each month. Eventually you do turn the corner and win

I can totally empathise with you. I've been ill for over 10 years and suffer with depression too (since 2003) I have limited mobility as well.

It's only since i found this site 3 weeks ago that i already feel stronger and more able to take on the DCA's.
