    • I (and other respondents) always advise “not getting caught in a lie” it hardens their response. Why would they now believe protestations of remorse and “I won’t do it again” if they've already seen you'd lie and say it was a one-off when it wasn't..  You can try approaching the prosecutor on the day, but "I wouldn't hold my breath" …..  
    • I told them that it was an accident and that I used the oyster card as my debit card was lost. However, they did an investigation and realised it was not a one off. I have told them how remorseful I feel and how a criminal conviction would result in expulsion from my degree but they still want to take me to court. I have received the court summons letter

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got a Bankruptcy petition. Due in court 26th March. Told godebt that i have no money or assets. I have got nothing to lose.

 

I do hope they make me go bankrupt, at least i wont have to pay my credit cards back

 

I will keep you all updated. Lifes too short to worry about these scumbags. more legal cost for them LOL

HI am hving the worse nightmare from GO DEBT,car finance my late partner took out with ycc and cancelled within two hours of the signed agreement,ycc accepted termination of the agreement after 6yrs GO DEBT is constantly threatening me via phone. My late partner passed away and they are now claiming i miust pay the car finance which we never had.i was threatened by them on 19/02/10 that they would come to my home address and drag me to court and make me bankrupt.

when i called to speak to the manager i was advised no managers everyones a manager,i was then asked to come to an agreement to pay off the debt which really does not agree and its illegal to threaten after 6yrs i am seeking legal advise as its them who owe us £600.00 deposit till date we have not received.i will advice if i get further info.

I suggest you log all calls and tell them to go away, hoping they won't. Send the usual harrasment letters. Make sure you answer all the calls and if possible record them. Then take them to court for harrasment.

do you have the original contract? you get 14 days cooling off period. you can cancel before the 14 days is up. I would let this ride and simpy laugh at them when they ring you and put the phone down. do not speak to these scumbags or confirm to them who you are.

Hi thank you so much. i am now in contact with the trading standards who are also looking into the matter as i received another one of their calls threatening me with doorstep collection in full or goods removed 9.00am this morning.

no dca can remove your goods..only a court can order that... this is simply a threatogram.we are noticing that godebt having taken over these ycc agreements seem to be getting more and more desperate in an attempt to get any money that they can out of people..do you still have the original agreement?

you have contacted me regarding the account with the above reference number, which you claim is owed by myself.

I would point out that under the Limitation Act 1980 Section 5 “an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued.”

I would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that “it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period”.

The last payment of this alleged debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from us in the relevant period under Section 5 of the Limitation Act, we suggest that you are no longer able to take any court action against us to recover the alleged amount claimed.

The OFT Debt Collection Guidance states further that “continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statute barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970”.

I await your written confirmation that this matter is now closed and that no further contact/action will be made concerning the above account after that last letter.

I certainly wouldn't be that polite debt4get, I would tell them where to get off and insist they take court action. i would be very rude on the phone without the use of profanity and not let them get a word in.

 

You really should get a telephone conversation recorder nita63 and take this all the way. Trading Standards won't take any action against them. They might get your letters and phone calls stopped and that is it. Godebt will just move on to some other poor person who owes nothing but might fall under their pressure and pay something they don't owe.

 

Trading Standards, like all the responsible authorities and bodies in this country, are totally useless and have no teeth.

the trouble with godebt they will take court action as we have been seeing over the last couple of weeks with regards to these bloody ycc agreements..they have been sending stat demands out like confetti..i know people can ask to get set aside but some people are going to be really frightened by these scumbags

oh i agree..it just seems that godebt by their past behaviour dont seem to...its not even the posters agreement and they are chasing them...they are unbelievable...and like you said ts wont do anything...

Due to a move (no fault of my own - I was ill) from on end of the country to another and not being able to find another job I was not able to keep up with the payments.

 

Yes car credit told me that if I handed back the car that I would not have any further money to pay that that would be it.

 

So I handed back the car.

 

A week later I was chased by GoDebt for the outstanding balance which was about £5000.

 

They most annoying thing was at the time I had only had the car for 8 months and I bought if from them for about £3500 but when they resold it they only got £1500!! My car devalued by £2000 in 8 months.

 

I queried with GoDebt the integrity of Yes Car Cedit at the time and stated that I had been completely done over and they said that as long as I paid them back an amount which is only £25 a month they were happy with that - for a debt company to be happy to receive this measly amount they must know that Yes Car Credit are in the wrong and they are getting money out of me that they shouldn't be getting.

 

However at the moment I am not sure how to go about challenging it so to keep GoDebt happy I am happy to part with £25 a month.

 

If anybody knows how to take these slime balls down I am happy to give it a go - as I still have about £4,500 left I would be happy for any pointers.

 

Also Go Debt rang me last week and offered if I was to settle that they would reduce the debt by half?? Unfotrunatly as I dont have a dime to rub together I am not able to take advantage - but such a huge reduction they must be getting itchy feet and trying to revcover whatever they can.

Hi I have a similar situation as you. I have'nt seeked any advice my story is a couple of years ago I made a huge mistake by going to get a car from YCC I was self employed young and stupid so I got a car from them. I could'nt afford to pay them so I asked if I could call off my contract (within 7 days) but they kept ignoring and telling me they would call me back. They reposesed the car now im lumbered with a £6000 debt with GoDebt. They called and hassled me and threatened bankruptcy and even said my mum could get chucked out her house! They were telling me to borrow the money off a friend or family to avoid bankruptcy. Is there anything atal I can do im currently paying £30 a month but I don't think it's fair I have to pay £6000 for something I have'nt got. Or is that just the way it is when you sighn the contract? My parents always advised me not to take the car but being at a young age you think it's all ok and not think about the consequences.

 

Any help would be much appreciated.

Martin I think you are out of order suggesting this is not to be used as an advertising board. The solicitors probably had no idea that their name was put on here so how can it be an advert. GDK was merely offering good advice. You know better than anyone that not all solicitors are up to speed with consumer credit. At the end of the day I thought this site was aimed at getting the best deal for the comsumer. A better way to look at the situation may have been to ask the solicitors concerned to sponser the site. I use many different forums and most don't allow advertising but of those I use I don't think any would have classed that as an advert. Now if Stephenson's came on here blowing their own trumpet that's a different matter.

I've read the thread and whilst there are issues there are still people on here who have found them very helpful. I still think that the post in question was not turning this board into an advertising board. If you do use a solicitor you have to be prepared to pay if you loose whichever solicitor you use so they ain't cheap.
