Well I put in a claim for £370 on 27th June 2006, sent my LBA on 11th July 2006 and I have now had an offer for £330 which I am willing to accept. The £330 can be used against court fees for any other claims :)

 

Thanks for the excellent advice and as soon as I receive my cheque I will donate to the site.

thats excellent, Did you have to send them a breakdown of all charges. I have just recieved a letter after sending initial letter stating they want a full breakdown before they will consider. thought may just be time wasting. That's great though for you well done! Did they threaten to close account etc or anything like that?

17th august 06-claimed back 725.00 from HSBC in full (personal account)

28th august -just added up over 19,000 in business charges with husbands HSBC account! ABOUT TO START PROCESS OF RECLAIMING MONIES.

The account was already closed and has been for a few years now. Yes with both letters I sent a breakdown of the charges. My husband has also received an offer yesterday but we are not going to accept this.

Thank you for your letter dated 13th July 2006.

 

I note your comments regarding your attempted justification of your charges. £30 for clearing a transaction which, for you, is an automated process and requires no manual intervention is excessive in the extreme, and does not reflect the banks costs for this action.

 

You mention in your letter that you believe you would win any legal challenge in court, if this is the case why haven’t you defended what must now be 100’s of claims against yourselves? I would be more than happy to go to court, in order to find out how you justify your charges.

 

However on this occasion I am willing to accept your offer of £330, ONLY on the condition that this money is refunded EITHER by a CHEQUE made payable to “XXXXXXX or paid into my joint account – account number XXXXXXX BY 25th JULY 2006. Failure to do so with leave me with no alternative than to reject your claim and pursue my whole claim, including interest, through the courts.

omg, that's great. I wonder how they decide who'll they'll offer a settlement to. They owe mw £442.50 and I sent all letters and they sent me a fob-off one after the LBA. Now they'll have to pay me over £600.00 when they get my court summons!!

Well we do have a joint bank account with them and a lot of money is deposited into it each month, I wonder if they have some form of criteria where they decide who they want to appease and who they don't??

A little update, HSBC didn't pay up so Moneyclaim completed £417.50 charges (found some more statements ;) ) interest of £153.49, Court fee £80, Total £650.99 :)

congratulations, you dont have to draft a letter, unless you really want to ofcourse ;) , you can merely put a line throught the confidentiality stipulation, and initial it, then return the letter as normal

Yes that is what I am going to do, although I do need to write on their letter that I want a cheque (as they could try sending the cheque to the DCA)

 

Does anybody know when I cease the moneyclaim action?? is it when I get my cheque or now that they have made the offer??

I'm pretty sure I read somewhere that you don't stop your claim until you can actually put your hands on the money. Just because they've agreed to pay doesn't mean they will!!

aggghhhhhhh HSBC I could scream at them, my OH checked our bank account today and they have paid the full amount of the claim £650.99, just checked our bank account this evening and they have reversed the refund, therefore taking the money out.

 

I will be phoning them tomorrow and giving them what for!!!

 

I have got a good mind to let this go all of the way to court!!!!

Christ what a saga, phoned the bank, because I had requested a cheque, legally they have to comply with this, so they reversed the payment in and have issued a cheque which I should receive Monday. Also got a letter from the Solicitors saying a cheque was on it's way.

 

I think when I get the cheque I will pay it into our parachute account with Natwest :)

Still haven't received a cheque !!!! phoned HSBC and she said I need to speak to somebody in another department that is closed at 5pm, said tough I wasn't going to phone back. Just phoned the Solicitors and told them that they credited the money to my account and then removed it the following day and that if I didn't receive a cheque the court action will continue.

 

I will do a letter to both the bank and solicitors tomorrow if I haven't heard anything.
