Following me checking my Credit references, Lowells have sent a letter chasing an old Barclays Loan debt to my current address it seems a coinsidence they must have been checking the references. They have not sent any correspondance until now. Following a failed IVA which defaulted in Nov 2002 this is the first correspondance regarding this debt. Do I ignore the letters waiting for the statute barred date to arrive or is the fact they sent a letter enough to keep this going another 6 years or shall i CCA them?

Yet again its about time this practice was looked into by the toothless FSA

I posted about this about a year ago, how my brother who registered for his free online credit report was suddenly inundated with DCA letters shortly afterwards.

You would almost think that these CRA's are financially connected to the DCA's.....oh wait, I forgot. Does not one of the larger DCAs have a financial stake in Experian..?

 

Also taken from Experians site,

 

Only lenders who are members of CAIS

can see it, and then only with the

consumer’s permission. They must be

companies who grant credit and must be

registered with the Office of the

Information Commissioner under the

Data Protection Act and be licensed by

the Office of Fair Trading under the

Consumer Credit Act.

Companies who access only public

information do not have to go through such

strict controls, because the information is

publicly available from other sources.

We record all enquiries and ‘footprints’ are

left on the database to allow every search

to be tracked so consumers can see which

organisations have accessed information

about them.

 

Perhaps experian would like to show why the likes of Lowells etc regularly conduct searches when they have no right to do so yet do nothing to stop this practice.

Of course I will pay you everything you say I owe with no proof.

Do not speak to them, do not write them a letter. Even if they speak to you on the phone that is not enough to stop the debt being barred under statute come november. They would need a payment or a written letter from you. So don't panic.

Chantry Collections - CCA sent
