Hi

After my recent marriage break down I want out of our joint nat west acc. They gave me a form that needs both signatures, but he is not willing to sign his part.

Does anybody know if there is another way please?

Thanx Trish

If NatWest don't know another way then report their adverts to the advertising standards people - that's whay they claim.

Seriously, they are probably the best people to advise, but beware, they can be particularly unhelpful.

The preferred method is for the individual to close the joint account and open a new, individual account. Any other method, assuming that the other joint owner is still alive, can lead to awkward problems and challenges later.

This being the reason for me asking here,as having dealt with Nat West extensively,I know only too well just how unhelpful they can be at times.

Thanx for taking the time in replying to me.

Pen a letter to here setting out your difficulties, it usually gets a good response.

Hold on, I think Goodwin has just been replaced by M Bischoff, anyway for now I would carry on with Goodwin (it is not like he deals with the matter personally).

Hang on a sec, get them to clarify, if the account is either to sign then either should be able to close it. If not then I can see where they are coming from, however when I worked at Nationwide we were able to put a dispute on the account which essentially suspended the account completely unless we heard from both sides.

Whilst this isn't ideal if there is a similar policy at Natwest you could transfer funds to a new account in your name and change any regualr payments over to the new aco****.

Not ideal but it gets what you want in a roundaboue way. If the account requires both signitures then I confess I'm stuck.

I assume its a current account? If so you would have seperate cards and it should be either to sign. If its a savings account then u have a problem.

The views I express here are mere speculation based on my experience. I am not qualified nor insured to give legal advice and any action you take will be at your own risk.

What would worry me if I couldn't close this account down would be an ex-partner running up debts, disappearing so I would be left holding the baby so to speak. Is this what worries you Trish? I still recommend talking to yourbank but indebtstudent has certainly come up with one solution.

Can you take out all of your money from the account, change all of your direct debits & wages to a new account & have your name taken off the old account (or the old account suspended as suggested a few posts above)?

It might make a difference if you were married or not.

Have you tried looking on some of the divorce help forums (even if you aren't divorcing)? This is a fairly specialised question but it might crop up more frequently on one of those sites.

Good job I turned up. Martin Bischoff, is the MD of NatWest Bank, and Sir Fred Goodwin is CEO of RBS Group, come on, a basic yahoo search gets you that info.

Finally you get the right answer!

Indebtstudent, you are in the ball park. The account needs to be frozen due to marital dispute. However the account, if it is overdrawn within the overdraft facility will still incur interest on the account. If the account is in credit or with a Nil balance, by freezing the account it will stop the account dead until such time as an instruction is received signed by both parties. To close a joint account or to remove a party from the account, BOTH parties need to sign an account closure form.

Thank you all so much for your time and suggestions!!!

I will opt for the dispute option and then there will be no option but to come to the latter as in a signature from both.

So once again thank you all very much !!
