      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been to the dentist and been told that i need my front teet taking out. They will be unable to replace them with a bridge and the only options available are dentures or implants. I do not want dentures as anything touching the roof of my mouth makes me heave. Does anyone know if i can get implants done on nhs??? I have also had a baby in last 12 months, would this matter as i am also exempt fot dental costs for 12 months... any help would be appreciated it took 3 years to find a dentist thanks

If certain criteria are fulfilled.

 

"Dental Implants are only available under the NHS in the categories listed below:

 

Congenital and acquired defects e.g. severe hypodontia (more than six missing teeth), cleft lip and palate

 

Tooth tissue loss following trauma, e.g. road traffic accidents; surgery for head and neck cancer

 

NB. Patients in whom tooth loss occurred due to trauma more than two years ago will not necessarily qualify for NHS implants.

 

Continuing problems with well-made and fitting complete dentures

 

If your patient fulfils one of the above criteria, the referral should be made in the normal way. Following the consultation, if your patient is suitable for implant treatment, the consultant will request approval for NHS funding.

 

If the approval is successful, the NHS will only fund the current course of treatment. The cost for maintenance and any future replacement cannot be guaranteed. In the event of a problem, a new referral and application for approval would need to be made".

So in your case, it would seem not. I have the same issue with side teeth and also have the gagging reflex, so you have all my sympathy. Try to get them to understand that you can't help it you're heaving, no, it seems you must be doing it on purpose! :-(

My 18 yr old son was recently attacked by a thug, who hit a bottle in his mouth, to cut a long story short, he had extensive injuries incluing having to have his jaw wired, luckily he is recoving however his teeth are a mess, the dentist has said he will lose 4 of this front teeth and a bridge is unsuitable due to the gums and other teeth being too weak to support it due to the tramua from the attack. He has referred him to a specialist for implants, however he is a student and nor him or I could possibly find the thousands this will cost, do you think he would have a case to have these implants on the NHS and if so how do I go about applying for funding? any help really appreciated. thanks.

I have just found this very useful thread after it has been muted that if my wife were to have implants they would cost £25,000 :-x

 

Can I seek some professional guidance on whether the work can be done on NHS:

 

Several years ago my wife had all her top teeth removed due to constant abscesses and now wears a denture. However due to problems with the denture being insecure she has now been advised that although her gums are shrinking there is a problem with the bone that is shrinking/crumbling and ultimately will reach a point where dentures cannot be worn without discomfort and will be ill-fitting. Any implants fitted to support a denture will first need a bone graft inserting due to the weak bone and if not on NHS will cost the above amount.

 

Given that this seems to be a medical condition (and not cosmetic) is it likely that she will receive this treatment on the NHS?

 

Any advice or assistance greatly appreciated. Thanks

Hi - not sure if I post in the same topic thread or a new one - but here goes!!

 

I have always visited my dentist for 6 monthly check ups and have always mentioned one particular tooth as "not feeling quite right". Not knowing what was wrong with this particular tooth but knowing that something was wrong, I put my trust in my dentist to ensure I received the appropriate treatment. He would 'check' the tooth but never suggested there was anything wrong with it, other then ever needing a filling. Over the course of several 6 monthly check-ups I continued mentioning that this tooth felt 'wrong' in some way, on one occasion I detected a hole in the side of the tooth where I could actually insert a pin in to what must have been a decayed part of the tooth. My dentist never previously picked up on this until I mentioned it.

 

The tooth had had a filling previosuly from what I can remember and on one day, part of my tooth fell away, so I went back to my dentist for treatment. A locum put a filling in place. This fell out shortly after and my usual dentist gave me a temporary filling and then replaced it at a later date with a permanent filling.

 

Throughout this time I suffered from bad breath which never seemed to disappear and on several occasions I was prescribed antibiotics to clear up the swollen infected gums around this one particular tooth. On no occasion had it ever been suggested that the tooth needed any more advanced treatment than a filling.

 

Having moved to a different area, I joined a new dentist who advised me on the first check up that I needed a root canal treatment. She had no hesitation in identifying this problem immediately. She attempted to carry out the root canal treatment but said that she wasn't able to drill far enough down for some reason. I returned to my new dentist for a 2nd attempt at which point I was told that something seemed to be blocking the root and she would be unable to complete the treatment. She described what seemed to be a tiny piece of metal (perhaps a previous filling) blocking her progress through my tooth root!

 

I was subsequently referred to a specialist who after several x-rays he immediately told me that the tooth has been 'treated' and filled so many times it was not stable enough to have a successful treatment as there was so little of my original crown remaining. He did state that if I had come to him first, he would have had treated me with the root canal treatment which would have had a significantly better chance of success.

 

Since these events, my filling fell out and my very weak tooth cracked in half. I had to wait over a bank holiday weekend to attend an emergency appointment and then a further month before I could finally have the tooth extracted. To add insult to injury this had to be a surgical extraction, which involved cutting into the bone to remove the half tooth followed by 2 stitches (as opposed to a standard extraction).

I have suffered from prolonged embarrassing bad breath, pain, discomfort and infections for several years and now I am left with a gap which will cost me further money to close.

 

Given the catalogue of disastrous diagnoses and treatments (6-7 fillings in one tooth) iis there any chance I could take this through a complaint procedure and obtain a dental implant on the NHS to rectify the situation I believe my first dentist caused?
