Hi,

I bought a 40 inch tv from currys in January 2007. The screen has now gone dead and I have an engineers report saying the tv is now beyond economical repair. I paid £499 for the tv and £20 for delivery + £65 for the engineers report.

I have been in touch with customer services who have offered me £360 in vouchers, including the report. To be honest, I feel this is a bit low as it means they are only refunding £295 for the tv.

When you're claiming under soga are they allowed to make deductions or would I be within my rights to push for the whole £500 I paid for the tv. How would I stand if I took it to the small claims court?

Repair is out of the question so I would have to buy a new tv.

Any advice welcome.

Any refund is entitled to make allowances for any use you have had of the item. The price of the delivery is a different issue (as it was delivered, after all) and without the engineer's report you wouldn't be able to claim, probably.

 

You paid £499 for a TV you have had for 20 months. They have deducted £200 of this for the use you have had of the item.

 

You can always try, but I would doubt that you would get a full refund, you might get more than £360, but who knows.

 

The question is, would the amount they gave you buy an equivalent tv?

Just a quick update. Handed in an N1 last friday for the price of the tv + the engineers report + 8% interest. Yesterday morning got 2 letters. First one was a letter from the courts saying currys intend to defend the claim, 2nd envelope was a cheque from currys for the full amount. Went out saturday afternoon and bought a new tv!

Hi Honestknob

 

A few years back had to take PC World to Court same company as Currys.

That went all the way to Court, but i still one the day in the end but it was a lot of hard work to get the verdict.

I've got a thread on hear at the moment about taking Currys to Court.

Congratulations, Currys are happy to take your money for a sale but do not know the meaning of customer service!

 

Did you claim for the original price of the TV or for the cost of the repair?

 

Also what did you put in the box for defendant? Was is DSG Retail or Currys?
