Hi

 

I have BOS Preference Account which is operated like a postal account. I have received my list of charges and I have written and asked for them to be returned. I received a reply today which went like this:

Dear xxxxxxxxx

 

Thank you for your recent letter regarding the late payment charge, which was applied to your account.

 

As per the terms and conditions of your original agreement, which you signed to confirm you had read, understood and agreed to bound by, a late payment charge of £25.00 will be applied to your account on each occation that the minimum payment is not received by the due date shown on the statement.

 

After assessing the OFT findings our charges will be reduced as from the 1 August 2006.

 

In view of the above, I regret to adviseI am unable to refund the charges in question as they were applied to your account as per your original agreement.

I thought the bit about reducing the charges interesting.

 

Anyway my question is this, I wrote to an address in Scotland for the list of charges but I do not want to go through the Scottish system. The Bank Of Scotland Preference Account is provided by Capital Bank PLC which is based in Chester. Can I send my Letter Before Action to the address in Chester?

It makes no difference where the bank is based, it's where you live that's important. If you live in England then you will be fine as it will be heard in an English court.

I want to start action to reclaim my fees from a preference account I had 4 years ago. I can't find the address of the company as I destroyed all corespondance when I cleared my balance. Does anyone have the address to send DPA request
