    • Hi, I'd change justice centre to county court. I also wouldn't be including a telegraph article in the bundle. It doens't prove anything law and you don't have distribution rights on it. I also wouldn't personally break down the exhibits on the index page, normally people have a seperate page for this right before the exhibits. The main index page normally just says Exhibits to WX of [Your Name] or at least that's the format I use/see people here use, although really it makes minimal difference.   I also see that despite referencing several judgements you haven't included the EVRi one   paragraph 46 really needs to go imo it has nothing to do with anything. Your in court to apply the law to your case, not to tell the judge about a newspaper that means nothing to your claim.   I also see you've adopted the issues in dispute/not in dispute, which is also known as a scott schedule. if you are taking this approach, for things not in dispute I would say this needs to be things that are agreed between parties, not things like "There is no dispute that I am happy to supply all this evidence which is included in the court bundle." I would say that issues in dispute is to focus on the aspects of the claim that are in dispute, such as whether liability is limited by insurance or not, so I'd be changing that accordingly.   BF should be along shortly to advise on things.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anybody tried to take on a Finance company yet?

I have had an account with these [edit] for five years and been regulary ripped off when job/circumstances changed throughout the loan period and I missed a payment. I have calculated from their own statement of transactions that I have payed over £500 in late payment charges.

 

I sent the LBA and they acknowledged this on 12/7 with a phone call to advise me to get a solicitor. The nice guy also said that he would supply me with a complete breakdown of their charges so am holding my breath at the moment but starting to go BLUE. I dont think that this will happenj, £10 per phone call and variable charges per letter £10, £20 and even £100, all in black and white direct from themselves.

 

I am wondering if anyone else has these experiences as I ( to date) have not found any posts about this, but will continue looking.

 

HOWEVER, good luck to everybody.

You have to ask wether the charges are reasonable, by the looks of things they are not, if the charges are deemed to be punitive, they are unlawfull and you should be able to get it refunded.

 

In other words, Yes i think it would be similer to what everyone is doing with the banks.

Thats what I thought. Will be interesting to see if they keep to their word and actually send me the cost breakdown of their charges. Even if they do however, will be worth the effort in taking them to court for several reasons.

1. I might win and lessen the burden for others that these charges were punitive.

 

2. To see if they let it get that far. Have already accepted that I had paid nearly the total amount so really have nothing to lose.

Obviously I have stopped holding my breath as I nearly passed out.:( I never recieved the promised break down of the late payment charges or have I had any further contact with them.

Am now going to send the LBA today once again by registered post, they should recieve it exactly fourteen days after the the the first one. Hopefully they are reflecting that I might mean it and make an offer shortly. I seriously doubt it, just wishful thinking.

Thanks BlueRuby, you are right this is in the wrong forum. Just know that they are subsidiary of RBS.

Don't know how to change it, perhaps a mod will help.

Have had another phone call from Steve today.

Apparently I signed the agreement allowing them to charge what they liked for failed and late payments. I cannot claim back these charges as the account is nearly closed.

When asked about a detailed braekdown of their charges I was told that he did not have to do that. He finally hanged up when I said that I would start procedings against them in the county court.

 

All this prat has managed to do is antagonise me to try and actually get them to court now. The money, although it would be nice no longer matters with these IDIOTS. They think that they are dealing with kids who do as they are told. However, I am now thinking that it would be worth forfeiting the money to get this company into court due to their arrogance. I just wonder when they will finally admit that they have charged me penalty charges and not just fees in conjunctiuon with the failed payments.

 

Will also pm a mod to move this thread to the correct forum.

At Last.:D

I received a phone call tonight from their collections department. They are now willing to close my account and leave me owing them nothing. The original final payment of £160 has at the moment grown to £255.

The girl was GOBSMACKED that I refused this amount. Did not know what to do next and said that it is what I wanted. I gen tly reminded her that I was actually after all the charges that I had been charged over the last 5 years. She ended by saying that I had agreed to their charges but she would be reporting to her supervisor.

I also reminded her that it was amazing that this offer came on day 14 after my last letter to them before I start court procedings against them. I stated this and will be delivering the necesary to the county court ASAP. As they have also issued a default notice, I now need this to0 be cleared in their full and final offer.

Hi Flinty been looking at all the info I currently hold on this company a little earlier today. I was unable to meet the monthly payments on a loan with them a number of years ago but been paying them a set amount also for a number of years. Didn't realise until today that each month it shows up as a default on my credit file, no wonder I have trouble with finance ratings etc:mad:.

 

Anyway to cut a long story short I have been unable to ascertain what charges have been lumped onto the account as I never have any correspondence from them at all including statements. Do you think it's worth writing to them requesting statements showing charges etc....?

They were initially the most frightening company I have ever dealt with. I dealt with one guy who threatened me with my house, telling me they could make myself and my kids homeless. I tried to explain the situation - he didn't want to know - in fact he said "boo hoo Mrs **** not my problem but it will be yours if you don't come up with a £1000 by the end of next week!" He then proceeded to phone every day thereafter. I contacted CAB they told me to write to them and make an offer -refused! As a last resort I contacted a solicitor who wrote to them making that offer formally and also he 'advised' them to cut the threats or he would instigate legal action. Fortunately they did listen but unfortunately been paying it ever since. So I would love to take them on!!!!

I issued a claim against Forthright Finance on the 28th July.

This followed the two template letters slightly edited so they applied to a finance Co rather than a bank.

 

If you look on the OFT consumer regulations website you will find that they have been slapped on thwrist over their agreements and penalty charges. Plenty of ammunition there

 

Our agreement with the company sounds like the twin of Boobaby's and I must have spoken to the same charming people.

 

We managed to stop the harrasment by applying to the local County Court for a time order (the national debt helpline will give you details). One Odd thing though, they issued a defaault at the time but my experian record sshows a good payment record with them

 

I calculated the charges from a statement that I made them provide at the time so avoided the Data Protection Act letter.

 

They really are bullies and deserve to be put out of business

 

I have heard nothing since the claim was issued, if they dont respond by the 10th I shall apply for judgement by default

Thank you so much for responding and please don't take this the wrong way!!? But I'm really glad someone else had the same harrassment that I had, I thought it was just me, nice to know you're not alone - that's why I sooo love this site!!

I will contact them but I'll have to do it using the DPA letter as I have no statements from these people what so ever and to be honest always terrified to contact them - "can of worms" or in their case "can of vipers".

Definetly take them on. They offered me £160 and closure of my account as paid in full. Have refused as they seem to have missed the point. I want all my illegal charges paid back.

 

I to had all the threats two years ago when I changed jobs and went from weekly to monthly pay. To avoid default and repossession had to pay them a fortune immediately, ended up borrowing to do this. Their arrogance over the last 5 years and especially the last 4 weeks makes me determined to get them to court if neccessary.

 

Will try and look at the template letter and amend it for you. I was lucky and asked for all my transactions before my last payment.

HI. all you need to change is the Account No. to Agreement No. Also the first paragraph from this:

 

Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.
