Incorrectly filled in documents

My wife was charged with an offence on Saturday the 23rd August - failure

to stop at red light and she was given 3 points and a fixed penalty of £60.

 

My wife had been driving her dads car with his permission as he is

incapacitated and awaiting a long term condition diagnosis.

 

When we went to show the insurance it was noted that my wife as a named

driver on both my policies was not insured as I thought to drive her dads

car - an oversight on our part clearly.

 

We have not yet went to deal with the insurance issue as I have tried to

get this looked at by Direct Line in case some dispensation could be given.

 

I do however note that the original HORT etc that has been issued has

actually been dated incorrectly - it says the 22-08-08 and not the 23rd

when the incident took place?

 

Where do I stand with this before I go back to Police?

An HORT /1 is a document that requires you to produce all the documents that you should legally have to drive a car (insurance, licence and MOT (if applicable)).

 

It matters not that the date on the HORT /1 is incorrect since it serves no other purpose than to require you to produce your documents, the only time that would matter is if you went on the 7th day to produce and the wrong date would lead people to think you were on day 8 (ie out of time).

 

If you were hoping to get off on a technicality I'm sorry to tell you it won't happen on this one.

no insurance is an absolute offense. wife may be in for an unpleasant endorsement and increased premiums for some time. Does dad's policy have any other driver TPFT clause ?

I suspect that the Dad's policy will allow the policyholder (ie the Dad) to drive other vehicles insured on a third party only basis, but this wouldn't normally extend to named drivers on the policy.

Most policies allow another driver to drive "in an emergency". Unless you can prove your wife was driving his car under those circumstances I think it will be recorded as driving without valid insurance I'm afraid.
