    • Yep, those 'requirements' not met to shareholders satisfaction seem to me to be: 1. Not being allowed to increase customer bills by 40% (of which well over 50% of the new total would NOT be investment) 2. 1 plus regulators not agreeing to letting them do 'things in their own time (ie carry on regardless)
    • As already mentioned freely available "credit scores" are fairly useless. All lenders have their own "credit scoring" system, that for obvious reasons they don't divulge. And they're "scored" differently to the freely available ones. As soon as they could, we've always encouraged our two children to use credit cards responsibly... Pay off in full, etc, to generate good history. It's paid off. At quite young ages, they have both obtained loans for cars, mortgage and their credit card limits are through the roof. Personally, I have shifted debt around a lot on credit cards (even financed a house purchase once at 0% 😉) and I've only ever been refused a credit card once, sorry twice by the same company, over many years. They must have something very different in their lending criteria. You're a tight one, Mr Branson.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

They got their results today, my DD got 8 C's and considering she had to do 2 years work in 8 months, she did fantastically well and I am so proud of her, she has been offered a place at a college in Winchester to study Child Psychology !!!!!:D

Another proud mum here my DD got all B's :D considering what she has been through and had to cope with the last 4 months she has done fantastic, staying on at 6th form to take A levels soooooooooooooooo proud :D :D

my daughter got all c s which im amazed at after the year weve had too and so chuffed for her she did however get one f for maths opsss still she going to art college dont think its a necessity for there to have maths so not unduly bothered although i know shes capable of the work just didnt want to congrats to all the other mums too xxkia

My DD got 1B and 7C's ......... :D

 

 

 

which is a vast improvement on my eldests (and school hating son - think I spent more time there than he did in his last 2 yrs) results. He told everyone that at least he could make a word out of his F U D G E ...... but he has been in fulltime employment since the day he sat his last exam 3 yrs ago

Thats only natural havinastella :D I did to it amazes me the number of exams they do these days the lummox got 13 GCSE's (he got an E too which still counts lol) I think we were limited to 8 when we took our O levels... 9 if you were really clever.

 

Anyway congratulations to everyone who has had their results today :)

Well it took her until late last night to tell us but my stepdaughter got 6 b's 2c's and a d

 

While we were congratulating her she opened another envelope that she hadn't bothered with earlier and guess what - an A that she'd overlooked:)

 

Well done kiddo and welcome to the wonderful world of nursing college:D
