Hello all

still stuck in getting this wasted cost done ...having personal issues in health to deal with and at the same time keeping strong for my kids ...and job is even more harder to get ...so working hard on that end too ..all happening but no real positive results ..but will keep trying hard.

 

I had a letter from Copes with a 'with compliments note' asking me to call them ..and I DID NOT and will not. WHAT DO I DO NOW? since they are the ones that have filed the Notice of Discontinuance ...can I complain and who do i write to and what do i write in this letter?

Hello Bob-I am just a bit confused-did you consent to the set aside ?

Also was there any mention of costs ?

I can only think that Copes want you to call them to discuss costs-You are right to refuse to deal with them by phone and have no obligations to do so.

I suggest that you write to Copes indicating that you will only correspond in writing,and that you will not be calling them.As regards preparing a wasted costs order,this will mean drawing up a list of how many hours this has taken,costs of postage travelling stationary any fees for court etc etc.

You should get these figures wrote down first.

many thanks for the site and directions ..will do some reading on it and see what i can come out with.

 

The Claimant has written to the court to have the Notice of Discontinuance to allow the set aside - does this mean the allege debt is still there and Copes/Arrow is pursuing the allege debt ...hence writing to me with compliments note asking me to call them.

 

I have previously written to Copes/Arrow with CCA and Statute Barred letter but they have not replied stating that they have a CCJ already and not obligated to send me anything.

 

Now, when I went to the court first time, the DJ did not allow my application to set aside CCJ (this was in November 08) Then in January 09, Copes write to court (and court have written to confirm) that Copes have issued the Notice of Discontinuance ...and court granted the set aside for the CCJ - I am assuming that there is no CCJ for now.

 

Are Copes writing to me to ask for the allege debt - If i write back to them stating that I will only deal with them in writing ..besides stating this, can i put in things like I have requested for CCA information and Statute Barred letter ....unsure what i need to put in this letter if i were to write to Copes

sorry all, ...it has been a long while since i last posted ...things has not been fantastic but I am alive and plodding on ...on the bright side, it has been a huge relieve that I did not received any more letters from DCA.

 

as to the costs, I did not managed to do anything to date due to some other personal issues which I needed to see to - it has now been about 9 months ....so I guess i cannot make claim now.

 

to all who are in similar position like i have been - stay strong and CAG and someone is around to support and help ... just need to hang on and be patient ....

Glad to hear you are plodding along. I would say, yes, you have missed the opportunity to retrieve some costs out of this. :( But as you say.. no more DCAs.. that has to be a bonus.

Hi All,

 

it has been a few months ...my mother passed away in February .......overall, things are a lot better albeit still a struggle at times with myself and others ....generally, I am feeling so much relieve that this ordeal is REALLY over.....and every now and again ..CAG came to mind and I come to read ...although not good enough to help others ...so this is to say to people:

 

DO NOT GIVE UP WITH CAG ....STICK ON AND READ WELL ...THE SUPPORT CAN BE REALLY FANTASTIC ....AND WHEN YOU WIN ...THE FEELING REALLY CANNOT BE DESCRIBED ....

 

STAY FOCUS ALL :)
