    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received.     • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello for the first time! I am currently fighting Nationwide for the return of £290 (in one hit due to a small clerical error!) they have returned £140 but are saying "that's it" They have said they now have 7 weeks while this is referred to some department or other. Is this true? To get legal with them a solicitor wants £300 up front which, err, I ain't got!

Any advice?

 

When Nationwide took my £150 it caused me to be overdrawn, which I'm sure they will charge me for. Can I get this back at the same time?

Just thought I'd let you all know. When I phoned Nationwide to complain about the length of time it was taking for them to reply I was told by the lovely lady on the phone that "that department is extremely busy at the moment" I bet they are. lol

You don't need a solicitor. You can do it yourself for free. Look at the FAQs and step by step guide. And yes, you can claim the charge back.

Some advice please. Nationwide's most recent letter to me states: "The Financial Services Authority (FSA) allows us 8 weeks to investigate before you have the right to ask the Financial Ombudsman to review your case. This ends on 7 August 2006. If for any reason we can't send a full response by then, we'll write and explain why." Is this just time wasting waffle or is it true???

Hi cillitbanger.

Thank you for your advice. My fourth letter to Nationwide was their letter before action and their 14 days has now run out. I therefore now have to start proceedings but don't really know how to go about it. I have downloaded the form N1, do I just fill this in and send it or does it need to be accompanied by a solicitors letter? I'm presuming the court needs to stamp it, at some cost?

P.S. Are Nationwide likely to close my account when they refund my money?

Yes just fill it in. You can send or take it to your local court. Staff there are v.helpful and will check you've filled it in correctly (but will not give legal advice)

No solicitor's letter needed

Court fee is payable when you file.

Short answer...yes.

 

But they will give you 30 days notice!

how much does it cost to file a small claim?

 

It depends how much you are claiming. I think you can chekc on the moneyclaim website but I haven't got that far yet so have a look and see. You should be able to find out there.

As promised the people at Nationwide took, the £150 the said they would. They of course waited till nearly the end of the month, a couple of days before my salary is paid in, when there was not enough money in the account to cover it. This of course caused me to be overdrawn and a standing order returned and they are now going to charge me £50.47 for the privilege. I think this is called taking the micky.

  • aaaarrrrrrr. the lovely nationwide. I.m currently fighting them. 3 years ago my marriage broke down. and I was forced out of my home taking with me my three kids and three suitcases. Our joint account was imediately frozen. Not having worked for 10 years the only money I had was a small amount in a nationwide account and an overdraft limit of £1000. I relied on this heavily in putting down a deposit for a rented house. Half way through the worst 6 months of my life, nationwide decided to take my overdraft down to a mesely £500. I was given 30 days to clear the outstanding. I was in a poorly paid job, and huge overhead costs. Square peg round hole! Since then I have been charged in excess of £4000 in 'penalties', and nationwide always seem to take their money first. I've never been able to get myself back on my feet. this year alone my account would be sitting in credit with no overdraft if these charges had not been made. The way I see it, I don't care how long or how much it costs I am going to fight them all the way. And with the CSA due for a shake up, maybe i'll get the money owed from my x that is due as well. Doubtful as he's skipped the country. I feel so angry with nationwide that they insist on these charges, causing me nothing but stress each month. They've just returned a SO for my rent, I was £40 short in the account. That was on a tuesday. I would have had a total of £986 paid into my account on that day at midnight. A few hours to soon and I've been charges £96 for that. They've taken that first, which now means It'll be tight month again. I am just about to issue a LBA this week, after countless phone calls and letters to nationwide. Only having received back 'standard' replies from nationwide. I now have a total of 10 frinds under my wing, and given them the various websites in recovering their charges as well. IT'S PAY IT FORWARD:D I wish you every success.

hi all, just a quickie about the court fees, remember if you are on any type of benefit take your claim form to the court with your proof of benefit and you will be exempt from the fees. those who have to pay the fees don't forget to add this on to the amount you are claiming as costs and get them back from the bu***rs!

Hi, Nationwide has caused me to leave University due to their charges as I was unable to pay my tuition fees. I am a single parent now, with 2 kids and nationwide have taken just over £1800 since feb last year. I think like everyone, you get caught in the viscious circle, you get charged for whatever reason, your direct debits are returned so they charge you again the month after. This happened to me because I was 10p short for a direct debit and was charged £30 + £20 for being overdrawn. Well after reading lots of threads on here I finally got the courage to do someething about it and sent the 1st letter giving them 14 days on the 19th july. I am just waiting to recieve the standard letter and then next week, off goes the 2nd letter.

HELP PLEASE. Just been reading the thread from "hi New'ish. Young V Nationwide". I was just about to pluck up the courage to take my N1 to the court and have seen "Young V's" notes about the MCOL site. I haven't heard of this and I'm thinking I probably should have!! Where is it?? Also, do I need to take copies of all correspondance to the court too?:confused:

What exactly do you want to know - I don't quite understand.

Just take your schedule of charges with you when you file and proof of your benefit entitlement (if applicable). Also you need 3 copies of the N1/schedule.

:-x Got their final response yesterday. NO CHANCE take your business elsewhere.

I am so angry with these people. I really believed that my request was quite reasonable, I'm asking them to right one wrong, over one small mistake (not going back years and years) and I really (naively) thought that they would appreciate this. I have held this account for 18 years and they really don't give a damn. I find the process of going to court to file the claim form quite daunting and I am having more problems opening another bank account than you want to know about. My claim is quite small compared to some in here and nothing to Nationwide, but it's making a big difference to me and all I've got to look forward to is them taking another £58 in 3 weeks time (because them taking the £150 took me overdrawn!):-x

Don't feel daunted about taking them to court. We are all here to support you and you WILL get your money back. And it is EASY, believe me. They won't have you stand up in a witness box, if they wanted to do that they would do it to a much bigger claim than yours.

 

If you want to talk about your problems opening another bank account and don't want to do it on here, PM me and we can have a look at your options together.

 

You NEED to get these charges back so you need to file a claim and get your money back - it is a wonderful feeling, honestly.
