Default from Bank Charges after claiming them back!! Help!!

Hi Everybody!!

After successfully claiming back £2300 in Bank charges from Natwest last year, i have checked my credit report and realised that while i was claiming them back, the bank was still charging me and subsequently put a default on my credit report for it. I have never claimed those charges back, only up to the point before then when i put in my claim.The account is now closed also.

Can anybody point me in the right direction of a useful thread.. or does anybody have any advice at how i should go about getting the default removed?:???::???:

Egg owe me £250 including interest

07.12.2006 - sent Natwest 1st letter ;)

15.12.2006 - Natwest offered £414.00 :|

18.12.2006 - sent 2nd letter to Natwest asking for the rest

08.01.2007 - Natwest claim serviced

16.01.2007 - natwest acknowledge claim

19.02.2007 - filed aq form

21.02.2007 - Natwest offered £1890 (not accepting)

15.03.2007 - sent 1st letter to egg

22.03.2007 - received letter from egg offering £44.00 (not accepting)

30.03.2007- Natwest sent me a cheque for the full amount £2360 :-D :-D

07.04.2007- Egg claim serviced

The big win was a hard slog.. but i got there in the end!!

Thankyou for the thread! I have sent out the letter to put the credit ref agency on notice. So we'll see what they reply back with!!.. no doub it will be a letter fobbing me off, but we'll see!

My only query is that, because they were still charging me after i started claiming, i could only put down so many charges up until the point that i gave the final charge amount to the court, so all the charges after that have never been claimed back. Hense would that mean that the latter charges i hadnt claimed for, would not be in dispute and so would be ok for them to issue me with a default?

Sorry if thats sounds soooooooo confusing!!.. but i just want to make sure!

My assumption - and what that's worth i've no idea! - would be that you would be entitled to make another claim! They have defaulted you on an amount made up of unlawful charges haven't they?

I'm sure i can make another claim.. but would i need to make another claim to get the default removed? I would do it, but its such a long process to do the charges which will take 4 months to get my money back and the amounts not that high, then to do the default after which could take several months would make it a very long process. I never really realised how much damage 1 default could do on your credit profile!! Which is why id rather get rid of that 1st, then deal with the charges after.

When I was in a similar postion I wrote to the bank pointing out that they had already paid out my claim to xxxxx date & that since that date, despite the account being in dispute, they had continued to add charges & interest & that I was now submitting a claim for the full amount accrued; also demanding removal of defaults as the true status of my account had been misrepresented to the CRAs. It took some time & several letters to the complaints dept. but eventually they succumbed.

 

Of course all claims have now been stayed so not sure how you would fare. :rolleyes:

I'll give i a go and see what they say. I'll try claiming back he charges and removing the default at the same time and see what they say. I'll keep you posted hun!
