DH (ie, Me on His behalf) sent a letter on 16th Feb to HSBC for charges on his bank account and a separate letter for his credit card held with them.

After getting the initial "we'll respond when we've done our investigations" pap and then hearing nothing else we sent another letter on 5th March reminding them that under the DPA they had until the end of the month to respond to our request for statements otherwise action would be taken as previously informed for an estimated amount.

We got a letter back from the Credit Card and the letter states:

"I can confirm there is no law which states it is illegal to charge customers who breach terms and conditions".

Now this statement to me translates that the charges are indeed a penalty for not adhering to their rules rather than to cover costs.

Is this a standard letter and what are your thoughts?

Can we have a scan please.

Doesn't matter whether it is standard or not.

Did they acknowldge your DPA rmender?

Remind them again. Warn them that a compliance complaint will be made about them.

They asked for £10 but DH spent a while in the cellar and dug the old statements out so I'm in the process of tapping everything into Excel then sending off their seven day letter.

Where do you want the scan sent to?
