      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You may get another offer made but it will only be slightly more than the other offer or you may get a phone call from a customer services person. Unless you are very confident and sure about the claim don't engage with them in any conversation. Just say that you don't wish to discuss the matter on the phone. You have made your position clear in your letter and you don't want them to ring again. You may hear nothing. Whatever they do unless they pay the full amount which is as likely as pigs flying file your moneyclaim once the deadline is up.

Bit of an update.....I was a bit worried about having no parachute account, but true to all the advice given on here a Nat West Steps account has been opened for me Pretty basic...but it has Debit Card, SO's DD's.....Link Cash Access....So now I feel better !! Role on 8th August.....claim day

Nat West cards arrived for parachute account....Isnt it good when you start to look forward tot the post !

 

Can anyone tell me the rough time scale...only had one offer so far..and LBA runs out in 10 days...am i liable to get another ? And if i file on Moneyclaim on or around the 9th Aug...then how long then ?

I had a £237 claim on my halifax credit card account. LBA was ignored. Summons issued. Acknowledgement filled stating they would defend. No defence lodged, but a letter offering to settle in full. Accepted the offer and waited for the cheque. They just paid it directly into my account. So just work throuigh the system and wait for the time to bring the conclusion.

Hi geordiebaz,

They should have my LBA by now as well, but as yet i have only received the complaints leaflet and see you in 4 weeks letter!(before sending the LBA) I am watching the letterbox 24/7 lol

I think the next we should expect is a paltry offer as full and final settlement which should be rejected or accepted a part payment.

Well all at the same stage, I am waiting too... Claim was ackowledge on the 18th July 2006... and they 'intent do defend' so just playing the waiting game. From what Ive seen on this forum they is it common that they send you an offering letter or do they just silently put the money in the bank...

 

However, I dont want to keep my hopes up either in the hope that they would pay up as nothing great ever happens to me!!!! Knowing my luck they do turn up in court!!!! :!:

June 27 2006 - Letter received from Halifax offer of - £407.00 (accepted as a Prelim Payment) :mad:

July 1st 2006 - LBA sent :p

Ok...here I am again, and only 5 days before Money Claim. No more word from the Halifax. Am I really surprised ? Still, onwards and upwards.

 

Capital One demanded £10 for a list of charges on my account, and gladly sent them FOC for my wifes !! Theres consistancy for you !

 

Strange reply from Monument though. A full pack of photocopied statements sent free withinn a week of request, and a covering letter telling me I couldnt claim anything back, and I agreed to their terms...blah blah blah...I think they know whats coming next..lol

 

Will keep you all posted. Off on holiday to Ibiza 12 days after the moneyclaim to Halifax ...hope a have a nice surprise to come home too

Right......still heard nowt from the Halifax. Its time for MCOL...can someone point me in the right direction for step by step procedures to do this ?

 

It would really be appreciated.

 

Also, are the Halifax paying out more quickly now ? I noticed some folk are getting paid only a few days after filing moneyclaim..

After a great deal of teeth gnashing Money Claaim is done...Checked with the Halifax to clarify HQ address & was put through to a customer services guy. He asked if it was re: a claim and promptly offered me £735.00 in full and final settlement. I accepted, but only as a part/interim payment and the claim would be proceeding...If they think bank charges are fair and legal...then why the hell are they offering fairly large sums as re-payments ? I am now going to battle...wish me luck
