      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Requested my 6 years worth of statements from Halifax 2 weeks ago....A mountain of letters dropped on the mat on Friday....all proper statments too (read a few stories about a few odd formats !) Got the highlighter out, checked all the charges...and added them up to £3303.00 plus interest !! Sent the 14 day letter out yesterday (11/10/06) & await developments...Will keep you all posted..

any idea how long it takes for the halifax to reply to the first letter (asking for the full amoount) ?, and does anyone who got their money back have any experience of having their accounts closed ?

Hi, I'm just a bit in front of you, my prelim runs out on sat and all I've had is a standard letter back with complaints booklet. So it looks like lba going on sat. As for closing account obviously I haven't got that far but they do seem to be closing some down. I think majority have stayed open though but its a good idea to get a parachute account opened else where just in case.

Plenty time to go before the LBA goes off.....(25/7), but reading all the stuff on this forum makes the adreniline flow ! Cant wait to drop nasty unpleasant letters on their doorstep as these s***s have done to me for years.

Just stick with your timetable. If you do get an offer then make sure that you add a bit to the next letter accepting their offer of £XXX.XX as a partial payment of the claim and that you intend to pursue the rest in court if necessary. Ignore their '4 weeks'. Good luck! :)

I have the template, but I am unsure as to whether I should include the interest and include the excel spreadsheet. The template has a section for overdraft interest...but I have no O/D...should I just put the nett amount in now and send the interest spread sheet off when I come to file the claim...hope all this makes sense ?

No need to add in 8% interest (as calculated on spreadsheet) until you reach the Moneyclaim stage :)

My LBA is due out tomorrow.....and I've had a offer today (235.00) on a claim of over 3300 quid...hmmmmm

 

My problem is this......I need to include the acceptance of part payment & my LBA together. Also, should I be claiming the interest now (I have done the spreadsheet)

 

What should I put in ????

I got a letter yesterday offering me £1300 tempting but if theyre willing to offer me that amount im sure they can afford to pay me the whole moolah! 28 days to wait.... does it really take that long?

 

Also got a letter today saying theyre intending to defend... :-| do I need to worry??

I calculate that you have taken £XXXXX (the total of your penalty charges) plus £XXX (see below) which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX.

There are 2 instances of interest you can claim:

1.When you go overdrawn the bank will charge you interest, perfectly lawfully.

However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.

Vampiress has a spreadsheet, (the 2nd one), in the bank templates library, which attempts to calculate this

It's quite complex and unless your claim is large often doesn't amount to that much, so for simplicity's sake, some people don't bother

This is the interest referred to in the preliminary and LBA letters.

2. 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before.moneyclaim

Right......here goes...........LBA goes out today to reach them by Monday. Watch this space. When I get my money back, a donation is on the way. Doing all this without all you good people on here would have been a nightmare.

Ok....done me letters for C Cards now....estimate there should/could be £ around £1000 there.....If/When I get all this money back I'll have to start doing some proper work....

 

Also its amazing how many people are interested in this now. Every one I mention it too is keen to get on board. I'm now not ashamed to tell folk I'm claiming money back, as there are thousands out there in the same boat.
