    • If a DCA supplies a reconstituted copy of the CCA what would be the next step. It seems that a reconstituted copy must be a " true copy " of the executed agreement, it must contain the Prescribed Terms. But given that there is no copy of the applicants signature surely it could be an agreement form with the details filled in. How can it be assumed that this " copy " represents a true copy that the claimant has supposed to have signed. Cabot have demonstrated a bit of sabre rattling when they say "Until we're able to provide this information , your account is unenforceable. This means we're not permitted to obtain a County Court judgement against you . Whilst we cannot pursue legal action, your balance remains outstanding ". I looked up a case... Cabot UK Ltd  v  Bachellier (2010) which might help, but it's tough reading, I'd prefer to plough through War and Peace. This particular case with Cabot is not huge , approx' £140, but the only other worry that I have is also with Cabot...£2100. They may try to make a point with lesser case.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sure the mods would probably have looked into it by now anyway ... but the board would be configured for that, any forum is. Some more than others. Trouble with IPs, anyone who wants to evade detection is they can use a variety of different means to avoid IP tracing. Anonymizer is one such package available commercially. IP routers. Although, they would be obvious if used ... sometimes. Unless I am wrong this forum is a php board.

 

Anyway, didn't get far cleaning ... need a new Dyson! Who said they never broke down?? :D Each time I look at the shape of the handle, how it slots into the main body ... well, makes you wanna rip it off and start singing:

wow - I didnt think this would cause such a comation. i pop out to get some shopping and come back to this. I only registered as I'm very interested in trying to give some help to others who are in debt. Seems like I have alot of questions to answer, to prove im genuine, which i'll have to do tomorrow. Personallly I dont see why I have to, but I will. Thanks for the replies anyway.

Ah yes, its not too difficult to hide or spoof an IP but we are talking about DCA employees here, the sort who would try to set up a network with a black and decker router...:p

Of course I will pay you everything you say I owe with no proof.

Now now....He has said 2 things that I havnt heard a DC here say for a long time.

1. That he is here to help.

2.That he WILL answer the questions that been put to him.

 

Lets give them the chance to do both.;)

Debtcollecterwhocares, can you please answer the questions asked by the group in the earlier postings on this thread. If you are here to help give good advice, then i welcome your input. Understandably you will get some abuse from some of the members on this site, tell us more about your job, and answer the questions posted earlier.

 

My own questions are:

 

How is the CCA request/ failure to provide agreements going with your company?

 

Has it affected your companies profits yet?

You did say that you were unable to advise people do make CCA requests because calls are recorded in an earlier post. Since people have a right to request that your company has the legal right to collect payment however, then why are you not advising them of these rights ?... call recordings or not.... or clarifying your legal right from the outset by sending people a copy ?

I have no objection to DCA employees being here. After all, we obey the law and guidelines and so should they. So on CAG we have nothing to hide from them.

 

If Debtcollectorwhocares really does want to help, then please show us by answering our questions and giving us some useful inside info. That's all we ask for. Then you'd get respect from people on here.

The best settlement to offer is 0% and a complaint to the OFT.

That's my only offer when they cannot produce an enforceable CCA. :D

I welcome any input, that is factually sound and unbiased. I would think if any DCA employee who tries to give advice that is prejudicial to a persons well being, or financial health, would be jumped on heavily.

 

If the two who have recently joined the forum answer some of the straight forward questions that are being asked, I see no problem.

 

So what does a DCA who receives a CCA request do, when it becomes apparent that it cannot be lawfully enforced? In my experience they pass it on to another DCA, or back to the OC. What is your organisations policy?

I have no problem with anyone being here but the motivation of a debt collector coming on a debt forum can only be suspect. The relationship between posters and debt collection agencies is severely damaged and no divorcee would come back and say "I want to help" when it is too late, especially as the abuse goes on. The majority of posters on here would find that impossible to stomach. The agencies would all have to clean up their acts for an employee to come on here and be accepted and that isn't going to happen anytime soon.

mmmm, 'others in debt' does this mean you are in debt. im sorry but your very screen name brings on a sickening feeling, you may very well have good intentions but for a lot of people here, your industry has done nothing but intimidate , scare, and bully not to mention lie and flout the law.

I am now debt free , totally , and its mostly due to the excelent advice hereon CAG, their advice is true and accurate and follows the law and rights of the consumer, what possible advice could you offer that is not already available right here ( apart from bias misinformation).

i , as many others, would love to know what pearls of wisdom you have to offer.

Typical DCA person. Always full of hot air, and they wonder why they get so much negativity and mistrust when one of them comes on here.

You may find that all forums you frequent are going to have their level of intelligence somewhat reduced for a couple of months :o;):D

When you've had all the help you need, make sure you stick around to help others too!

Just think, if everyone left the site after they'd got their help, there might not be anyone left the next time YOU come back needing more assistance!!!!!!!

Ah yes, but I'm not a teacher. Behaviour support/counselling (teenagers :eek:)... DCAs have nothing on some of the kids (and parents) I deal with, believe me... :lol:

Are you saying that you were a naughty boy, Fuzzybobble ?.... :D

 

I have my own darlin' teen BB... but it doesn't stop us from being at loggerheads at times. Mine and yours aren't a patch on some of the ones where I work though... I sat and listened to one young lad describe how to make a petrol bomb not so long ago.... Others have had a horrendous background... and some parents are less than desirable, to say the least.

 

Never a dull moment.... but I do love the job, the kids and the majority of those I work with !! :D ... and there's one young lad who I'm particularly proud of right now as well.

 

Stroppy teenagers ?... no worries. Debt collecting for a living.... no chance in Hell. ;)
