    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Anybody heard of CFS or the above phone number,

DH received a text message today,

addressed to Mr Duffer's Mum,

saying please ring this number and speak to Jenny and quoted a case reference number.

He rang from our home phone which is number withheld and asked who they were,

they said they were a debt collection agency and he promptly put the phone down.

Now he is not like me and doesn't actually owe anything

so if anybody knows anything about these muppets please could they let me know.

Dh's phone is a pay as you go so its easy enough to get another number via new sim card but we don't want to go down that route unless we have to. Thanks :)

Depending on what you find out next, depends on whay you should then do!

There will always be people here willing to help so let's see:)

  • 2 weeks later...

Have now received a couple of letters from this mickey mouse company.

It is apparently in connection with a subscription tv service.

We used a debit card to pay monthly for this service and when a new debit card was issued we forgot we had a payment set up on the old one.

The tv service stopped and as we didn't use it we didn't bother to enquire why it had stopped.

We received no letters or phone calls or anything from the company concerned

the first we heard was when Dh got the above mentioined text message which we obviously ignored.

The latest letter we have received threatens the usual rubbish, we MAY do this, we MAY do that etc.

Should I send a letter to them requesting sight of original contract (one wasn't signed, we subscribed through the TV), and a copy of the invoice.

As far as we can tell we only missed one payment so therefore they should only be claiming for one month, not for the whole year! Thanks :)

I have an ongoing hoo hah with CFS, I will see if I can find my thread to link.

They are a bunch of muppets, I am playing a great game with them at the moment.

They are lots of fun.

Can't find it.

they allege that I purchased a porn channel off satellite tv.

Now I know it wasn't me,

I am an open minded gal,

but pornography just aint my box of whatsits,

but someone else who was in my house at the time,

and who used my sky box and my debit card to pay for the channel without my consent.

This was done just before christmas and I didn't realise that they were taking money from my account until the new year.

I stopped the direct debit, and agreed to pay a token £1 a month until I had CCA'd them.

They obviously have no CCA but have cashed the postal order I sent them.

When I called up to talk about the account, the young lass on the phone screwed up kind of big time by not putting me on hold, and I heard her swearing about me to her boss.

I put a complaint in to her manager.

He phoned me back pretending to be bothered about the swearing incident, but ended the call by trying to get me to pay £10 a month off the debt.

They have passed the 12+2 on the CCA, cashed the postal order and I have invoiced them for dealing with them, currently standing at over £350, reported them to OFCOM, Trading Standards and the Office of Fair Trading. :D

They are a bunch of fools who don't know their asp from a hole in the ground.

Beating the DCA's day by day

My fight:

NDR - CCA'd 12+2 passed

Bank of Scotland - CCA'd 12+2 passed

CFS - Win by Technical Knock-out!

HFC Bank - CCA'd 12+2 passed

Chantry Collections - CCA sent

Time flies like an arrow

Fruit flies like a banana :D

<---------- Have I given you top advice, have I made you laugh, click on the scales, it won't hurt you!

  • 3 weeks later...

Well this lovely company have now passed this alleged debt over to some mickey mouse firm of "solicitors" who say we have 7 days to pay or else the will issue court proceedings. Quite how they can issue court proceedings when there is no contract is beyond me, but they obviously think this will scare us to paying, which obviously it won't. Sent a letter to CFS in early August asking for a copy of the signed contract and an invoice, neither have been forthcoming, I guess we just write to these "solicitors" and tell them we have requested copy documents which haven't been supplied and to go forth and multiply. Is it worth CCAing CFS when we know there was no contract as nothing has been signed?
