    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

So what they are basicaly saying is, they, a company that has no right holding my data in the first place, are going to asign an agreemant that doesnt exist to 'a' company, but cant make up there minds who yet, (though i doubt Moorcroft would be daft enough to buy it:p............on second thoughts yes they would:rolleyes:) which would mean passing that data that they have no right to have in the first place to a third party which they have no right to pass it to and are going to asign all the rights of something that doesnt exist to whoever they choose:confused: which means one of the lucky sods above will recieve my data that they have no legal right to have.

Dear Mindless Fools,

Thank you for your recent letter. If I could understand what you are twittering on about then I may be able to formulate a suitable response to your gibberish. As I see it you are telling me that you are passing on something which you think I may or may not owe but you will pass it on anyway even though you cannot prove that i even owe it or that you have any legal right to do so. However if you can find some other bunch of Cretins stupid enough to give you money for nothing then go for it. In fact if you know such a company then plese let me know because myself and my friends on CAG would be very interested in selling them nothing as well.

I used to have fun with Moorcroft & Westcot about 10 years ago & was engaged in a letter tit-4-tat with them both.

Id write back each time stating...

"It is with prefound regret that i receive your letter, please note that your conduct in this matter is unacceptable & will not be tolerated"

Id always finish the letters off with...

"please note that no furthur correspondence will be entered into"

Play these DCA's at their own game thats what ive always done

I take it this tat from Reliable Collections, who are anything but reliable relates to some account from JD Williams. ie Shoe Tailor, Ambrose Wilson, Fashion World, ect.

And yes these DCA's are daft enough to take an unenforceable debt on. I had the exact same letter earlier in the year and the next I heard was from the Moorcroft Crew. Who were quickly sent packing.

If it goes to a DCA i hope it is moorcroft, they know me:p already sent em packing twice:grin:

Even better if they buy it and cant send it back though, do you think the sale will be exempt from JDW home aproval policy so they will be stuck with it when they find out its duff:lol:

Actually no this was from Nat Close themselves but as there the same........

Just realised but the letter has said u can pay by your visa card. Would that not be against OFT guidelines as it is extending your borrowing?
