In answer to a complaint, Wescot say, amongst other things, that they are not the data controller, merely a data processor and as such they have very little information, so anything they do is in good faith and not their fault ...

 

I thought that data processor argument went out years ago

 

and not having much info - if they don't get enough they should ask the OC for more!

 

any ideas

Sounds like they need a little letter to remind them that they are responsible. Under the new Unfair Trading regulations that came into force in May this year, as they are attempting collection of the debt on behalf of the OC,then they they do have to comply with your CCA request. Remind them that if they fail to comply or continue to fob you off with excuses, you'll report them to the OFT and the FOS without hesitation.

 

I've had a few DCA's try this one on me in the past. They do it, as they know most don't know the law, and use it to fob you off, so they can continue with their threats of court, etc if you don' pay up.

They were passed the account as agents after the previous DCA didn't supply the CCA

 

They threatened to visit so I had to respond to their threatogram, so I asked for money to cover costs, that is the main part of their response, the other part being [edited]

I'm really keen to get anyone's opinion on the 'data processor' not 'data controller' point. I thought that data processor was an obsolete term.

 

If they are misleading I will throw CPUT against them

Nice one. I just hope a few DCA's I've invoiced recently send me some goodwill gestures. :D

 

Just goes to show that if we keep sending them bills for all the letters and stuff we have to send them, sometimes they will pay up.

 

I think the DCA's are now treading very carefully as soon as they realise their victim is aware of their legal rights.
