Hi all! This is completely new to me, so pardon any stupid queries! :|

 

Since reading everyones results I have decided to go for it.......

 

I have one question for now, but I am very sure there will be a few more as the claim goes through.

 

Here goes, my online statement back in July 2000 states :-

 

17 JUL DR ..... CHARGE ------------- 1.00

19 JUL DR ..... INTEREST ----------- 3.43

19 JUL DR ..... TOTAL CHARGES ---- 27.50

 

I am assuming all I can do is claim back the 27.50?

 

any help appreciated.

I have sent off my 1st letter requesting to see all my charges, then realised I can do it myself online!

Here goes the trawl, just finished 2000 get back to you all with a figure in an hour or so.

Hi Guys, just sorted out the prelimenary letter, just a little confued, maverick advised me that I can only claim back the total charges bit ie 27.50. but the letter is suggesting i also add on the interest? ie the 3.43.???

highlighted in red.....

 

What I require

I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX .

I enclose a schedule of the charges which I am claiming with this letter

in the post it doesnt say you can claim back only the ones which say total charges, i hope thats just a crossed wire, it says you can claim back almost anything which says charges on it, anyway

 

the red wording is in red as its optional, you dont have to put it in there, the reason being what i said in the sticky post

I said "I am assuming all I can do is claim back the 27.50?" you said "yes, you are correct". Thats where I got mixed up. sorry. :(

 

It was me who highlighted the wording in red to bring attention to the question.

 

anyway, forgetting that,

 

after your help and all others I have sent off my prelim letter this morning, via special delivery to my local branch, with the breakdown of charges. so lets see how it goes........ I couldnt have done this much without you all, thanks for all the help.

Just to keep you all posted, I can confirm my local Hsbc bank where my account is based, this morning signed for my prelim letter before 10 am. I could even tell you who signed for it but thats overkill!

Special delivery may be expensive but its great being able to track the progress.

 

Lets see if they pull the "we never received it, sir" stunt!

cheers Baracad I checked it out but I must be reading it incorrectly. still need help I am assuming this letter is pointing at the red bit ?!? but it states in my letter he wants me to call him!!!! is it ok to ignore and let the deadline proceed?

 

One of the following will now happen:

 

A) The bank or Credit Card company will ignore your request and you will not receive a reply. If this is the case, allow for the 14 day deadline and proceed to the next stage of the claim.

 

B) You will receive a fairly standard letter saying "sorry you are not happy, we'll get back to you sometime in the next decade..." Again, if this is the case, allow for the 14 day deadline and proceed to the next stage of the claim.

 

C) You will be offered a partial refund but it will be offered as a "Full and Final" settlement of your claim. We would advise you to accept this - but only on the condition that is is a partial settlement and that you will continue with your claim to recover full funds.

 

D) You will be offered a full settlement of your claim. Experience shows this to be very unlikely at this early stage, but it just might happen.

Hi,

 

I deifnitely wouldn't advise ringing him, as they try to back you in a corner and make you look stupid if you are not 100% about what you are talking about. It's an intimidation tactic.

As I said just ignore their letter and when your 14 day deadline is up sent your LBA out.

You will probably receive more letters saying much the same, but just ignore those too, unless one of them is making you a full and final offer!!!!

I am very disappointed that you have failed to respond to my letter of the [XXDATEXX].

I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations.

Don't be concerned, just leave that line out. These letters are only templates and you just adjust them to suit your situation

Progress Report.

 

Ok people........... I have just got back from a week away and i have recieved all of my old statements! never have so many envelopes rammed throuigh the door!

Amongst the statements was a letter from Ian Sheperd returning my £10 cheque "happy to waive any fees for the porduction on the information".

 

More importantly its LBA day! 25th of July!

 

So as I mentioned in my earlier post. I have been contacted by the bank manager, so the first line is a little lie. (in red)

 

LETTER BEFORE ACTION

 

ACCOUNT NUMBER: xxxxxxxxx

 

 

I am very disappointed that you have failed to respond to my letter of the [XXDATEXX].

Hey Peeps, Just to update you all with the timetable progress, As expected I have heard nothing from the bank after the Lba had been sent and received.

 

Roll on Tuesday/Wednesday when I shall be doing the Moneyclaim bit.

 

Cannot wait to get 8 percent back aswell now! Just going to do the spreadsheet.

Ok people, If there is no full and final settlement letter at home tonight MCOL will be called upon, I have done lots of checking and double checking that my claim and figures are correct just need the thumbs up from a few wise ones..............

 

here goes,

 

 

Figure I am claiming is £2235.50

 

8% Interest I have added up using the 'easy' excel spreadsheet is £493.13

 

Grand total of £2728.63

 

Lastly £2235.50 x 0.00022 = 0.49p which is my daily interest rate.

 

all agreed?
