Hi

i have an outstanding american express amount that i pay through capquest (they are a pain in the bum to deal with) can i ask them for the legally signed agreement and handover letters etc, as all im worried about is if they dont comply can they then stop me paying my agreed amount each month and withdraw my agreement for this monthly payment, then i will be in a worse situation

i hope someone can help me

If it is an Amex credit card then yes....if it is a debit card then no......are there some excessive charges that have been added to the account also ??

Can I ask - has the debt been assigned to capquest - if it has then irrespective of whether it is a charge card (payable in full every month and not covered by the Consumer Credit Act) or a credit card (where you don't have to pay in full every month which is covered by the CCA) for the assignment to be effective you must be served with the Notice of Assignment

who would serve me the notice of assignment, when i first got into difficulties with american express, they referreed my account to a debt collection agency, cant remember their name who asked for payment in one go, we said no we couldnt afford to do this, then another debt company wrote to us and we started paying 20.00 a month, for about 1 year then out of the blue a letter arrived saying they had sold the debt onto capquest, who we then had lots and lots of grief with before they finally accepted 20,00 a month, so does the letter saying they were selling the debt class as a notice of assigment?
