Hi,Im a new member to the forum but feel i have to post if anything just from pure frustration!.I purchased a 2 and a 3 seater recliner sofa from L of L around 14 months ago and ofcourse i purchased the fantastic 5 year insurance that would cover my sofa for everything,like an idiot!

Long story short both sofas have tears below the seams called insurance company their response was that as the panel was vinyl and not leather then it was not covered,they then told me to take up the issue with the store where i purchase as it sounded to them that i had been miss sold the policy.

I then contacted the store and spoke to the manager who informed me that i would be covered and that i should write a letter to him and he would then forward to the insurance company,i have written said letter informing him that i believe i was miss sold a policy which apparently only covers parts of the furniture,and also if this matter is not resovled then i would seek repair/replacement using the sales of goods act.

Now i have read alot of similar cases on this forum and i was suprised to see some negative responses such as you get what you pay for etc,but as i have only recently been medically retired from HM Forces im afraid this was all i could afford and infact i used a part of my settlement to purchase the furniure as my family and i had to leave forces housing and move into council accomadation.

I dont think that 14months is a suitiable length of time for a sofa to last before it starts falling to bits,i am hoping the manager will get back to me ASAP but i hae a feeling this is going t be a n uphill struggle?,

Well, for starters, "you get what you paid for" is not a condemnation of your circumstances, it is a general comment that the more you pay, generally speaking, you'll get better quality. It's not a reflecection on the buyer, but a reflection on consumer life itself.

 

14 months is not suitable length of time, you are quite right.

 

As a matter of curiosity, what is the reasoning being given for the policy being mis-sold? Have you checked the T&Cs yourself and does it in fact state that only parts of the sofas are covered?

 

The way I see it, with the limited info you have given, these are the possibilities:

 

  • The guy who sold you the policy told you you were covered for everything, but the policy has exclusions: Mis-selling. You go for refund of mis-sold policy and use SOGA 1979 to get your sofa sorted, and possibly complain to the OFT under the new CPUT 2008 for LoL unfair practices.
  • The policy does in fact cover for everything, and the insurance are trying it on: You insist the insurance sort it out and pays for repairs.

What you must not let them do is pass you from pillar to post, which looks like that's what they're doing.

 

Do you have the copy of your insurance policy? Instead of listening to them arguing back and forth, read it and see what it says, it will give you the direction in which to go. If you don't have a copy, get one.

Thanks for advice bookworm,i will have a closer look at the insurance certififacate but im pretty sure it does not mention any exclusions regarding the leather/vinyl not being covered.

I think your right the insurance are trying to fob me off,apparentley he has this problem with Land of leather furniture all the time?,trying to make out its there problem and not his.

L of L sat the opposite of course! so yeah i think your right they are passing the buck,maybey hoping i will lose interest and let the matter drop but i am determined to get a result after losing out to bank insurance who refused to pay over 12 months while i was recieving hospital treatment,my own fault i signed and did not realise i would not be covered after a year,so lesson learnt read everything !not much i could do that time but im not losing out again.

I will wait for a response to my letter from the store manager and see if he has a solution,but got the impression he had heard it a dozen times before and wasnt really interested,told me to be reasonable or he would end phone call?,would not even let me speak just kept repeating write a letter,pointed out to him that his staff could not have been more helpfull when i purchased the sofas,and that i did not appreciate being spoken to like a naughty schoolboy when i had a legitimate complaint,anyway i will post more when i have had a response from him. :)

i have had same problem with my seatte i am so annoyed with land of leather they never want to rectify the mistakes they make what a joke all mine is ripped at seams recliner not working arm is loose and one seat is bigger than the other
