Hi Guys

 

Does anyone know if Capstone Mortgage Services has have a legal indemnity clause, I heard today that they may have as a company who they use to deal with SPML has.

 

Can anyone advise???:-|

Capstone Mortgage Services Limited are NOT the mortgage company, they are merely an administration company acting for Southern Pacific Mortgages Limited and Preferred Mortgages Limited. I do believe that both of these companies probably do have such a clause, given the way that they do business.

RedHen, from my understanding both SPML and PREFERED could have had ideminity clause, depends when mortgage was taken out , this would be in your terms &conditions when you accepted mortgage offer.Helford is spot on capstone are a admin co looking after the mortgages.

Thanks for that guys will look into the T & C.

 

I have read though on some other sites that they can be claimed back ie exit fee and the charges incurred unpaid dd statements charges and arrears charges?? Just like the Banks as we do have T & C there

Any advice would be great.

Redhen, yes there are T&C which will have the prescribed charges that are allowed on your contract, which should stop any ADMIN CO ( ie CAPSTONE MORTGAGES)that take over your mortgage impose their own charges/or inc the charges.
