      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hmmm, argumentative b*ggers arent they. Did they in fact advise you that you could purchase the insurance cheaper elsewhere ?:) I would suggest you take your case for the PPI to the Financial Ombudsman.

 

I think there are some counter arguments in the Bank Charges forum for the ones they quote in their letter re the charges. Might be worth your looking through those.

first of all contact direct group for all details they have on you

pt will prob drop in and advise on the legal aspect, but as well as Information Commissioners Office a complaint to the fos is in order

 

dont worry about this as this is the norm

dont take no for an answer

Hi CitizenB, No nothing was mentioned requarding any aspects of PPI, She just gave me info about the loan and told me to sign she printed my name and dates on all documents i just signed, she didn't even give me chance to read them. I was in and out in less than 10mins

Personally, I would start working on your complaint to the Financial Ombudsman Service. When making my claim against HSBC, I seemed to be locked in a never ending round of letters of "We wont pay you, cos we are right".. I just wrote back to them and said ok.. fine, I will use your last letter as a final response and make a complaint to the FOS. Within 48 hours I had a letter saying they would cough up.

Hi Animal Lover, just read through the crap they sent you lol.

 

I am waiting on pretty much the same from them so have started digging - Direct Group ADMINISTER the insurances, they do not supply them.

 

They only do the 'admin' on these policies, I checked into their company details (companies house/Information Commissioner etc) and they do not and are not authorised to sell insurance.

 

So they are not your insurer - which that letter seems to imply to me. I would still demand to know who the actual insurer is....really annoy them :D

Hi Dipply75, That's what i did when i sent for the missing info from my S,A.R request. I asked for all insurance details including policy and ref numbers etc... aswell as the underwriting sheet, details of who sold me the policy and if they qualified along with the Default notice but they completely ignored it.

They really are acting like they are hiding something as postggj says, certainly time for that official complaint, you have been more than reasonable so far.

 

Can I ask something - all those documents they mention, suitability and breakdown of figures etc. Did you actually sign these? Reason I ask is that in response to my OH CCA request they sent piles of stuff he had never seen before - all with his signature on.

LOL no probs. to be honest i'm not to sure what i did and didn't sign, she didn't let me read them, she just pointed to where i needed to sign and stupidly and desperatley i signed. All i know for sure is that all of them that have asked for my name to be printed and dated are not my handwriting so who knows my signature isn't the hardest to copy. :(

Looks as though you could argue that you were given no option to do other than accept the PPI ie no PPI no loan !!. Also the fact that you were not given any details. or advised you could get the insurance elsewhere at a cheaper premium. Do they not have to send all the insurance documents to you within a certain time after signing ?.

ive allways smelt a rat with all the insurance welcome sell

cant say to much yet till i can confirm

you need to keep up the preasure

try asking how much commission the sales rep got, they will not tell you but will get them thinking. its obviouse it was missold and you were conned. welcome are very good at that.

ill let you know of my investigation into the insurances that welcome sell

Yep please do tell i'm sure it will be very interesting to know, I'll start my complaint straight away.

I added about the commision in the S.A.R but they just totally ignored it along with the rest of the info

you need to get the ball rolling

first thing is a letter to the ico detaling the fact that you applied for your sar, which is incomplete.

encose all documentation and what are the things (data) that is missing and that welcome decline to give it to you

 

you also need to put in a complaint to the ico

doing that will cost them £400

give your reasons for misselling, medical history etc, every thing that has been mentioned.

enclose the full and final response from welcome.

the fos are well aware of welcome.

 

again dont worry

 

at first i was the same, twenty questions.

we are hear to help, been there, done that, got the tshirt.

you prob realise by now i hate welcome with a vengence, they gave me four years of hell but i beat them in the end and will gladly pass on my experience.

Hopefully this £400 is the same for RBS for my case lodged with Information Commissioners Office months ago.

 

I would say to animal lover as postggj did, do not worry they are very slow but very very understanding. Once you have sent a complaint in, keep them up to date with copies of anything else you receive so they have the full picture.

 

If you would care to look at my thread you will find it full of complaints responses. It could even be worthwhile copying your complaint to the Information Commissioners Office to the FOS, OFT, FSA, BBA and any other organisation you would like to know about the treatment you are getting. You do not get action from them all but it gives them work to do for a stamp. Eventually they will all get the message loud and clear. Stop Mis-selling PPI.

 

Yours a bit miffed with PPI responses or the lack of:x

I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep fighting! i recently took Welcome to court over the misselling of PPI and won! i recieved my cheque yesterday but it did take 6 months of hard work and research to prove it was missold but thankfully it paid off. IT CAN BE DONE if you have a genuine case which i'm sure you do you have nothing to worry about - give me a shout if you need any help

As a former Welcome employee for many years, I can confirm that the agreements are likely to be legal they take great care to make sure everything is above board on the surface. If you signed a Demands and needs statement and the agreement then really you will struggle to get them to remove the PPI. However if they do not have evidence to prove then they must remove it. If anyone has any further questions on the company let me know as I know all about the working practices / and adding chreges to accounts that are not legal etc.

 

If you send a letter to the complaints department recorded delivery you will probably get the PPI removed
